    I have nothing productive to add but am also enjoying the thread.

    OP you want your bike back we all agree with that I am sure it is just simply your Bronson esque approach to achieving this that is a touch worrying.
    You need to be certain (and you cannot be) that the person on receipt of it nows it was stolen. They are just as likely to be a victim of crime as you are.

    Mr Lawyer if you use the same technique and style in court can I attend

    If I get the chance to take it back, it's downhill for about 1/4 mile from there so he'll need to be pretty good to catch me

    reading this all a bit late but afaik a claim of compensation has to be substantiated and quantified by the claimant. and seeing as the person pictured is
    1) unnamed
    2) not easily identified.
    side shot obscured by window shop frontage.
    3) and previously acknowledged as possibly "having bought it in good faith".
    4) and posted onto an MTB forum as opposed to a national newspaper.
    Can you substantiate any damages from the readership of this forum?

    BOTTOM LINE – I DOUBT VERY MUCH A SUBSTANTIATED CLAIM FOR DAMAGES COULD BE MADE.

    I am a lawyer. We have a word to describe such actions – "defamation".

    Only if he is not a theif or in receipt of stolen goods and has a reputation to lose.

    Just call the police, stop taking stupid pictures and putting them online you mong.

    whereas calling someone a mong is suable – you numpty – and I can safely call you a numpty as your posts on this thread show that you are an ignorant numpty.

    chris82, yes i work in a call centre full of lawyers 🙄 Also, it might interest you to know that probably less than 1% of lawyers involved in commercial law ever have the need to go to court, and that you are confusing "the law" with "the judicial system". Easy mistake to make.

    I accept that my attitude has been rude throughout this thread, but let's be fair, you lot have hardly been outstanding internet citizens have you? I've taken way more abuse than i've handed out.

    for all those who think they are more qualified to provide insight into the law, you might want to get yourselves one of these first (like the one on the wall beside my desk)

    every solicitor has their practising certificate cover 1 Nov to 31 Oct each each year, it doesn't vary, then the firm gets you a new one when your old one expires. a nice new bit of paper on your desk one morning that looks exactly the same as the one before but with new dates one it. it's terribly exciting.

    I've had diarrhea today. But with free mobile internet, this thread and the mojo one, it's hardly been any inconvenience at all.

    (As an aside, for a statement to be defamatory the imputation must tend to lower the claimant in the estimation of right-thinking members of society generally, so posting it on here might not count)

    ^ i'm no litigator, but there are certainly a number of cases where libel has been established where newsgroups and websites have been the medium used.
