Parking fine, what are my chances?

I fear I’m going to get a fine but what do you think?
Crystal palace park, I was there this afternoon and went in the main entrance off anerley hill amd parked on terrace straight about 13.45. Didn’t spot that it’s gone from free parking at weekends to new ANPR controlled RingGo parking, fee at all times. Returned to the car at 1545 and saw the signs, checked the app, paid then for 3 hours and left. The fee parking ends at 1630. So clearly I’ve paid ample to park, but have to admit I didn’t pay on arrival. Am I going to be hit with the £100 fine now? How long do I need to be looking out for the fine arriving Inc the post?

Edit to add. Ahh, no. I asked to pay for 3 hours but since the paid parking session was soon to end ( 1630) it’s charged me for ‘upto one hour’ I was there over that. I’m done for aren’t I?

1oceanskipperFull MemberPrivate parking is a money making exercise not a public service so 100% expect that in the minuscule print on the signs it will say that unless you pay within the first 30 seconds of arrival you will be liable for a “fine”. They will then be within their “rights” to fine you the standard “rob the bastard “ amount also displayed on the signs.
neilnevillFree MemberThanks onza, but I’m guessing I edited after you posted. I paid as much as I could but having checked I have only paid for 1 hour, I was there 2 hours give or take a few minutes.

Fines and penalties can’t be imposed under contract (that’s why the amount is calculated as liquidated damages).
But apart from that, absolutely right!
neilnevillFree MemberI’m resigned to receiving and paying my first ever parking fine.. but 7th minor motoring offence fine in a year including doing m stopping in a box junction after a pedestrian stepped out, and my wife entering a bus lane 10m before it ends. Driving in London is costly!
OnzadogFree MemberAh yes, I replied before the edit. If you’ve had more than you’ve paid for, you’ll probably get a penalty charge notice. They love to try and hit everyone that they can in general.
stumpyjonFull MemberHmm something doesn’t smell quite right here. If it’s ANPR controlled they will not be be issuing a Penalty Charge Notice as they say on the website (which is a major no no as public and private PCNs are 2 completely seperate things) as only council’s can do that and they have to put the notice to driver on your windscreen.
If you do get a PCN let us know here, be interesting to see who actually issued it, and on what grounds. If it’s based on bylaws (don’t identify the driver and they can’t hold the keeper liable) or under POFA, protection of freedoms act 2012 in which case they can hold the keeper liable as long as the PCN has the relevant POFA wording on it and is issued within 14 days.
Cameras are not always as good as people think and they will need to have caught you going in and coming out to issue a PCN by post.
Private parking tickets are not fines, they are invoices but they can still be enforced so don’t just ignore it. Worst case is a CCJ but you can avoid that even if you lose in court.
Next steps really depend on who issues the PCN and how it is worded.

However I am not super hopeful….although I did win against Lewisham recently when I drove past a ‘no motor vehicle sign’ which was unlit and invisible, rotated out of view and with no pre warning….so I know sometimes it’s worth a challenge on this stuff.
johnstellFull MemberIf I get a fine – I pass it on to my brother (uk) and if he gets one he passes it on to me (aus) generally they give up at that point.

1neilnevillFree MemberOk, parking charge notice has arrived from cpm UK car park management.
@stumpyjon it says‘You are advised that if after the period of 28 days beginning with the day after that on which this notice is given – the amount of unpaid parking charge specified in this notice has not been paid in full, and we do not know the name and current address of the driver, under paragraph 9(2)(f) is Schedule 4 of the protection of freedoms act 2013 we have the right to recover from the keeper so much of the parking charge amount as remains unpaid…..’
So I don’t think I can get out by getting my wife (the car is hers, she’s the keeper) to refuse to give the drivers (my) name.
I don’t think I can appeal it either it starts
‘ we have issued a parking charge…. as on 8th Dec at 15.50 it was parked on private land in breach of….. The reason we issued the parking chef’s is failure to pay for the duration of the stay…..’
And over to the side of the page it shows the photos of me arriving and leaving, states entry time as 1340, exit time 15.50
That all seems correct as I arrived to do an event starting at 1400, and checking the text message I paid/ tried to pay at 1549 (but at that time could only pay until 1630 and hence was charged the fee for upto one hour despite trying to pay for 3 hours)
Only saving grace is the free is reduced to 60 quid if paid inside 14 days. Ho hum, lesson learnt, look now carefully even when parking somewhere you have many times….. charges can change!
alricFree MemberId be fotografing their notices, if its not blindingly obvious that the terms have changed id deem it too sneaky to enforce, and hope they can see it that way too

stumpyjonFull MemberYep, sounds POFA compliant so can’t wiggle out of it that way. The parking management company is an IPC member so will likely reject any appeal as will their ‘independants appeals adjudicator. If they had been BPA you might have a had a chance.
Trouble with pay on entry car car parks is the payment proceses tends to assume the time you are paying is the time you entered.
You could ignore it but it could end up in court, your choice really, £60 now or possibly £220 later if they pursue it, they may not.
neilnevillFree MemberThanks. Since it’s right next to Crystal palace station and would be full with cars that never paid if they were not the sort to pursue…. they clearly are the sort to pursue. Besides its a fair cop, even if I feel a bit peeved I couldn’t pay when I realised my mistake.
