    Okay I don’t own anything apart from a computer, a car and 5 bikes so I wonder why not let them stay until the contract ends and not renew it?

    Or pay them (1 month rent or negotiate) to move on which can still cheaper than court proceeding?

    The tenants haven’t paid any rent for 3 months at this point; the rent was only just covering the mortgage, so it’s really not an ideal situation. I’ve asked the OH about just giving them money to gtf, her response was “you mean if they pay the £2600 they owe me?”, which I thought kinda covered it quite well…

    I don’t think there’s a winning solution here, unfortunately, but it’s good to have the guidance, thanks.

    nicko74 … 3 months rent arrears is a nightmare and I wonder why the tenant is doing so. Surely if they cannot afford to live there they should move on as the property is not theirs. Yes, they might run into hardship but the landlord may face the same problem too.

    Owing money to the landlord is simply not on regardless of the tenant’s arguments. Tenant owing money can only ask for sympathy etc from the landlord but nothing else.

    Sometimes I wonder if we human have lost all sense of right from wrong …

    I have a feeling this will be rather messy as the tenant seem determine.

    Also if the tenant cannot afford to live in London why live there?

    More info coming out – 3 month arrears then the agent should have started eviction proceedings already – ages ago

    Sorry, I’m lost. Why on earth would you provide ‘security of tenure’ when all you are paying for is a service based on a contract. Seems a bit weird to me that a tenant has ‘rights’ over a property they don;t own and only pay to stay in based on a contract.

    im pretty sure you can persue the unpaid rent through county court (small claims).
    if the tennant wont play ball, and ends up with a ccj for not paying rent, it pretty much scuppers them when they do finally go to another agent and try to rent another property. messes up trying to get affordable credit too.
    thats assuming that the agents are doing the correct checks.
    not all agents are bad though. as a contractor, i do repairs for a couple of agents locally and they are on the ball.
