Ello, just trying to clear something up with accounts.

I currently work 5 days in 4 and look after my daughter on the day I don't work.

If I worked 5 days a week I would be entitled to 24 days holiday this year.

Because I work my week in 4 days this should be adjusted, does anyone know how much I should get?

It's a bit confusing as I am off Mondays so therefore if its a Bank holiday I still do a full weeks work yet if I want to take a week off I only use 4 days holiday..

    Confused tbh.

I understand that Bank Holiday entitlement isn't 'portable' so in your circumstances you lose out.

You work 80% ful time so should get 80% holidays – 19.2 days.

Not sure re Bank Holidays – think this may be up in the air/discretionary.

pro rata so in your case you would get 24 /5 x 4 or 19.2 days

Bank holidays are also pro rata so you are entitled to 4/5 of a normal working day for each BH [ assuming normal terms and conditions] you "dont" work as you normally dont work anyway. You will owe them for Good Friday though.
EDIT: if they dont give you BH you can ask for more money or take them to court as they will have changed your terms and conditions – assuming you got them when FT and you contract has not changed only the hours worked. BH are not statutory holidays – that is an employer does not legally have to give them but if they do they must give them to all workers not just FT workers.

you are entitled to 28 days holiday a year minimum although this does include the Bank Holidays for a full week. Pro rata, assuming your days are of equal hours you are entitled to 4/5 (22.4 days)minimum.

It would depend upon the policy your company have in place as to whether you get the BH added or taken out of your minimum entitlement. The company

Our part timers get all the bank holidays but they're paid pro rata

Sorry Monkfish do you mean 20 + the 8 bank holidays as a minimum? The extra 4 are for the length of time I have been employed.

Err – am I being thick?
    .
I read you OP as working FT hours, but over 4 days instead of 5. My sister does this and gets full holiday entitlement.

Wot rkk01 said. You work full time over 4 days so your entitlement doesn't change, does it?

Maxray – yes. As a legal minmum you are entitled to 4/5 of 28 days which include BH.

That link posted above should answer all your questions.

How does holiday pay work then? Will the op then get 1.25 days pay for each day's holiday, since this is (I've always thought) based on annual salary?

I do the same as MaxRay – we call it compressed hours. 37 hours in 4 days. I also look after sprogs on Monday.

The easiest way is to convert the holiday entitlement to hours. Add the public holidays as hours too and then deduct holidays as hours from that total.

    So for me its 30 days + 10 public holidays (dunno exactly), which equals 40 days = 40 * 7.4 = 296

To take a weeks holiday, I have to take 37 hours off that total.

It does all work out properly.

Just to clear somehting up that appears implicit in this conversation but needs clarifying.

    Example
If you work 2 days a week and take the week off, you get paid holiday for the 2 days in that week that you would have been at work

I get the bank holidays added to my leave entitlement, then get 4/5 of that to use in the year. I'm expected to take all bank holidays off as leave unless that's my non-working day.

As Monday is my non-working day then I don't have to use holiday for the majority of bank holidays and get a few extra days to play with.

I'd expect something similar for yourself. You'll not lose out as you only need 4 days to take a full week off. If they expect you to take 5 days for that then I'd expect you to keep your full entitlement.

As others have said, if you are working compressed hours (ie a full week in 4 days rather than 5) you should be entitled to the normal number of holdays, ie the 24 you quoted.

You are also entitled to the 8 bank holiday days, therefore your entitlement is 32 days in total.

As others have said, you then need to convert the 32 days into hours and then consume them in line with the hours you are actually working. IE if a compressed day is 10hrs, a day's holiday debits you 10hrs from your entitlement.

If a bank holiday falls on a work day you must use up your holidays to cover it. If your day off is a bank holiday you do nothing as you wouldn't have been working anyway.

Has something changed, as far as I am aware this is incorrect and the legal entitlement is 21 days for an FTE, INCLUDING bank holidays.

br – the legal minimum is 5.6 weeks (based on 5 day week) = 28 days.

    This includes bank holidays.
