    Dont know the inns and outs of employment law but if you’ve raised issues of unrealistic targets and performance etc can you not try for Constructive Dismissal? I’d imagine they’d want to avoid this. As I say i dont know the inns and outs but I am sure a specialist in this area could advise.

    santacruzsi – by his own admission he hasn’t hit targets (ignoring the team being low on staff etc). Given this and 6 months employee, so CD is off the table. Constructive dismissal is more about forcing someone out on the sly by changing their role, sidelining them, putting too much pressure on them etc not sacking them.

    I was thinking the same then thought that maybe if he’s getting shit for under performing at work maybe logging on to STW straight after his meeting wouldnt be the best plan?

    I suppose it depends on whether he accepted the targets at the outset or not. And I doubt he could claim for constructive dismissal after just 6 months in the position.

    Went through a similar experience to yours in my early 20s – it really hurt at the time, but it ultimately set me on a completely different career path, and looking back on things from the perspective of my 50th birthday, I’m pretty satisfied with the way things have turned out for me: working from home, lots of quality time with family and friends, setting my own priorities and focusing on the things I think are important in life.

    Whatever happens today, it’s really worth thinking about what you want your life to be all about, then starting to plan for how you get from where you are now, to where you’d like to be. It can be a long road which involves some pretty radical changes in outlook, but it’s absolutely worth it. Crucial to get your spouse’s support as well – I don’t think I’d have achieved much if my wife hadn’t backed me 100%.

    Hmmmmm not sure what the “targets” are – is this a revenue based thing or a project timeline type scenario?

    I quite regularly have to have little sit downs with guys that work for me who might not quite be hitting sales targets. The first thing I ALWAYS look to do is put together a performance management plan. It’s not about being soft, cuddly and “there there”. That simply delays the inevitable – the way to do it is to identify a set of actions that are required, match those to resource to allow them to happen, and a defined timeline for them to happen in. Turning this round the other way for you gives the following:

    – Targets have not been met. You have raised this concern several times on record.
    – Action to either address resource issue or put together a secondary plan or review targets has not been taken by your bosses.
    – The situation CAN be resolved with commitment from both parties.

    Here’s what to ask for:

    – Establish performance management plan with reviewed targets and a timeline to achieve them. Both parties to agree to these
    – Agree resource plan (whether staff or budget) to allow this to happen.
    – If resource cannot be made available, review target again.

    And repeat these 3 steps in a loop until a mutually agreeable solution is found.

    Obviously this is all hypothetical as I don’t know the nature of the business or the targets in question, but my experience working in a multinational tells me that any decent sized organisation will have a process in place where they go to a performance management plan ahead of firing, so as to minimise the risk of constructive dismissal cases.

    I was facing the sack for gross miss-conduct about 4 years ago [justification]expenses fiddling like everyone else in the company[justification/] and was somehow saved at the last straw but my colleague got dismissed. In that time we both looked around and a job came up which we both went for. They offered me the position but I declined as I still had my job. He accepted and is still there to this day on twice the money I get….they never asked for references.

    Horrible situation and I notice they sent you the details on a Friday when you weren’t around so you’d pick it up at the weekend thus ruining that for you.

    I know its difficult and you are fearing what is coming up and how you’re going to cope, but having been through this myself i would say only this:

    One door shuts, another one opens.

    Things happen for a reason.

    You’ll look back on this as just a bad chapter and soon forget about it. Just stay positive and don’t blame yourself….it probably would have happened to anyone who took that job!

    I was in this situation around a year who, had been with the company 11months. I got dismissed on a Friday afternoon, and by the following Friday had a job offer with my old firm. Just goes to show it can’t hurt to ask if there are any positions. I had to do a bit of padding around why i left in the 1st instance, but they took me back.

    Not read all the thread/comments but the main thing is your family, you have them to support you no matter what happens and there is always a way forward, try not worry too much, something will turn up, it always does!

    If he’d been binned, he’d be at home on the internet, I assume. So the fact that he’s not on would suggest he’s still in employment.

    Or, he’s still in the meeting having a shouting match.

    Or, he’s been binned and is now in the pub getting hammered.

    Or, he lost it in the meeting and attacked the staff, and is now in a cell.

    Been made redundent 2 times in my working life, first time was hard, 2nd time not so, now work for myself and have done for the last 20 years and would not change a thing, it can be tough looking for new work, but things always work out, and Im my own boss and asnswer to NOBODY, (apart from HMRC) lol.

    My advice, dont stress over it, from what you wrote you are not happy there, this maybe what you need to move onto better things 😉

    Use it as an opportunity Mog. I know its hard but i was sacked and then made redundant some time later and both were the best things to happen to me (however it was hard to comprehend it at the time).

    Keep your head up, enjoy yourself and just thnk what you really want to do and how you are going to acheive it.

    Making money isnt that hard when you dont have to go to work everyday if you have your head screwed on

    OK, so back home and had some tea, kids cuddled and in bed.
    It was as I feared, however, I went in early and did a bit of prep work just to be on the safe side. Sort of on the offensive but in a professional way.
    Accusation 1 – outstanding admin submissions.
    Evidence 1 – batch headers showing my team had submitted (our bit) but admin hadn’t input (not our bit) passed to line manager calmly and politely.
    Accusation 2 – missed targets.
    Evidence 2 – performance broken down per head in my team to demonstrate that if I had 4 more ‘heads’, as I’d been requesting, the targets would have been hit. (actual x 4 = as near as dammit)
    Accusation 3 – no staff development.
    Evidence 3 – emails sent to local colleges requesting enrolment dates for specific courses for specific staff.
    New Accusation 4 – I’m not authorised to enrol staff on external (cost) courses without telling anyone – how would line manager know I’d done that if I didn’t tell them?
    Evidence 4 – Fair enough, I’ll take that feedback on board, thank-you, can I leave the training requests with you to advise on appropriate development?

    Line manager and other manager seemed to flap a bit and really made me feel uneasy in terms of giving me the ‘you think you’re being smart do you?’ looks. Break in proceedings while HR were contacted (no HR present). The result is a 3 month extension to probation rather than successful probation which shows me that I can do no right there, but pays my mortgage for 3 more months while I leave under my own steam rather than theirs.

    So all in all, more good than bad.

    I would like to genuinely thank everyone for their advice, I actually used a lot of it in the meeting. Really, really appreciate it – thank you. I think their minds were set to dismiss me until I forced them to ring HR due to the supporting evidence.

    Now I’m going to bed and hopefully getting some kip.
