Warrenty advice please? (hopefully not the usual question)

I bought a new bike a couple of years ago and it broke last year. Yeti sent me a brand new frame in Feb. This has still not been built (the dealer knows this as he sold me the parts to build up my new team bike, hence no need for the new frame)
I am trying to sell the replacement frame but the dealer says he won’t honour the (5 year) warrenty as it is effectivly second-hand.
Can they refuse to honour a warrenty on these grounds? I know some have a clause in about it applying to the first owner but is this legaly enforceable? Car warrenties transfer to new owners…

Most warranties don’t apply to 2nd hand products in the bike world.

Seems fair to me, second owner means it’s second hand and warranty T&C will tell you if you it can carry over or not.

Warranty is supplied, through dealer, by manufacturer/distributer. The can put whatever restrictions they like on there (like Fox demandign forks be serviced 3 times in a 24hr race or warranty void).

Even Sale of Goods act would only apply to original purchaser, I believe.

Sale of Goods Act – If less than 6 months old the onus is on the manufacturer tp prove that the defect is not a manuafacturing defect – in effect a 6 month warranty.

After 6 months and up to 6 years (I think) there is still redress in that if you can prove the defect if due to a manufacturing defect / unfit design you can still obtain a repair or replacement.

A manufacturers warranty is however at the discretion of the manufacturer and infers no rights other than those stipulated in the warranty agreement. Hence yes they can restrict the warranty to original owners only. This does not copromise your statutory rights as described above
