Bought the lad a secondhand GPU Asus 3080 something from a business seller on ebay in Feb and it looks like it's gone tit's up. Guessing, as we're outside the 3 month window, we're screwed? Local PC repairman is checking it over but the signs aren't good.
Without wanting to rub salt etc this is the risk with buying second hand. If it's worked for 4-5 months since you got it then IMO that is well outside what the seller is responsible for and long enough that whatever has gone wrong could have been from your usage.

What "3 month window" are you talking about? Goods sold by a business have satisfy CRA and this states that faults in the first six months are deemed to be inherent unless the seller can prove otherwise. Even, as far as I'm aware, if they're sold as second-hand. Though you might have shot yourself in the foot by involving a "repair guy" instead of the seller, it would be easy for them to argue that he's buggered it up.
TBF, that's not really "Ebay woes" is it? Surely Ebay woes is more like "buy something, have it turn up not as described, sent back and then mysteriously gets lost in the post" sort of scenario isn't it? You just bought something second-hand and it has failed.

He's not repairing the graphics card, just identified it as a potential cause of the issue
I suppose you could contact the seller (and not mention the third-party repair guy) and try to resolve then.

You miss my point. They could easily say that even if it's not true, and it would be difficult to challenge.
I have - successfully - been an "expert" in a court case where I argued exactly this, our customer should have come back to us in the first instance when there was an issue rather than going to a third party who pissed it all up. (Which to be fair he actually did because he didn't understand what he was looking at.)
Anyway. The crux here is that, ebay aside, you bought from a trader rather than a private sale and that conveys rights. You need to talk to the seller, and you need to be using phrases like "third-party inspection" rather than "repair guy."
Are you confidently certain that it's faulty? What's the problem? "Potential cause" is a somewhat ephemeral statement.

That sounds like nonsense to me I'm afraid. If that is what he told you rather than you (not being a dork) misremembering/paraphrasing then he's just lied to you because he doesn't know how to fix it. Being generous, he's dumbed down an explanation. Did you get a written report? I'd like to see that if so.

Good. If it is a legitimate business then they should know how to handle returns claims.
But a word to the non-dorky, I would be reluctant to make technical statements that you don't understand. I don't say that as a slight, rather I worked Support for years and I know this dance. Stick to objective facts, if the screen isn't showing blue then say "the screen isn't showing blue" and leave working out the 'why' up to them. You might not be a dork but you presumably have working senses, what did you see, what did you hear, what (yes really) did you smell?
At this point in time, based solely on what's written here, I think your repair guy is a chump and I have my doubts that there is anything wrong with the card. Now, what I think doesn't matter, but what I think is what any other Dork being paid actual money to make you go away is going to think too. So you need to get your ducks in a row. I'll help with this if I can.

Anecdotally probably true in my experience, I bought one a few years ago that I had to re-flash as the mining BIOS was still on there.

My lad came downstairs a week after we'd installed a replacement SSD, claiming "I'd" buggered up his graphics card.
After some focussed questioning it transpired that he had just tried to update the driver for the graphics card, but installed the desktop, not laptop, version. His device was indeed a laptop.
Reinstalling the correct driver fixed it. Still waiting for the teenager to re-boot in Adult mode...
