We will be in touch
Hi,
Unfortunately I have just returned from five nights in the major trauma unit at LGI. A car overtaking in the other direction lost control and hit me head on at I would guess plus 50 mph. I had almost stopped and was at no fault in the accident.
I suffered a smashed right arm and broken shoulder. Question is, what do I do now? My phone is ringing with claims companies offering their service.
I am really shaken and just glad to be here. I do want this person punished for their driving however.
Any advice is most welcome.
Well don't just sign up with the first claims company as you need to work out what commission they'll take etc.
They are vultures.
What does your insurance say?
Speak to insurers before any claims companies.
Get a mate to help you sort it out initially - you will be shaken still.
Heal quick.
See a solicitor
My insurance have links with a legal company and this guy wants to come round and sign me up!
The crash was also caught on camera from the lorry that was overtaken so it is as black and white as it gets.
Any company recommendations?
A lot of the "panel" solicitors for the actual insurance companies tend to be some of the better ones as they represent the insurers and are audited by them, do not go with any of these Accident Management Companies that you tend to see advertising everywhere and chasing you on the phone.
Just make sure you try and have the following:
- Any witness details
- Police details.
- Keep hold of any invoices/ receipts/ wageslips for loss of earnings, medications, taxis, etc that you have paid out for, it is a lot easier to claim back for things if you can document them.
Also if at any time you are unhappy with the solicitor acting for you, you are entitled to chnage them at any time.
If at any time the NHS is being slow with physio or other treatment, also get quotes to have it done privately and press them to pay out for the treatment.
Finally, as much as it is tempting to go for the first offer, make sure that you are well on the way to recovery first, don't go settling only to find out later that you may require further treatment or incur further costs.
Any problems or quires, feel free to use my email in profile, i was a claimant lawyer for years, and no work on the other side for an insurer defending claims for a fraud team.
Thank you so much guys much appreciated. A step back, time to heal and think sounds the best plan.
Very kind scud I'll keep that in mind.
Regards
I am leeds based my firm does not do pi but I can put you in touch with two that I recommend if you want . avoid claims management co's and go direct to a solicitor.
3 year time limit and you need to be sure of the prognosis before you settle so plenty of time do not be rushed into any decisions.
