Just looking for some opinions.

I sold a job lot of 57 phonograph cylinders on evilbay. They're antique records in the shape of, well, a cylinder. Here they are [url= http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&item=280533263058&ssPageName=STRK:MESOX:IT ]HERE[/url]

I strongly advised local pick up due to the size and fragility of the collection but the winning bidder was in Belgium. I packed them all up using a whole roll of bubble wrap, put them into a substantial cardboard box, covered the box with FRAGILE stickers and posted it off.

Got an email today from paypal saying that the buyer reckons the goods are "significantly different to the description" and that they have opened a dispute.

When I logged on and looked at the dispute in paypal, I got this message;

We have received the box in good condition, but there is something wrong with the contains.

There are 9 cilinders broken and there are 3 boxes empty.

There are 57 cylinders - the empty boxes I just threw in as a bonus. He's asking for a £71 refund - what would you do? Claim off the post office? Tell him to go jump? Cough up and chalk it down to experience?

Until I get the dispute settled, my paypal account is blocked - it's already showing a negative balance for the full amount of £336. I hate paypal.

surely this is the couriers roblem not yours.

You should advice him to contact them.

With the 3 emty boxes maybe you should advice him to calculate the total

Pretty sure it's the sender's responsibility to pester the courier / post office...

I've seen this trick before; they're just trying it on to get a discount. Ask for the lot to be returned and offer full refund on your receipt of goods in proper order. The chances are high that they'll back down

Cheers for that bassspine - I'm slightly concerned about calling his bluff though - if he does return them I'm not in a position to easily refund the cash 🙁 Could be dangerous.

Just as an aside, I've no idea where he's got the figure of £71 from - makes no sense at all.

Were thy insured? its your responsibility to get the goods to him. You didn't so he claims against you.

whether you can claim off the courier is a different issue

Get pics of broken cylinders and packaging.

Did you package them well enough? If so then speak to the courier. Seems a pro rata discount is in order.

When you shipped these items, you will have had the option of insuring them. If you made adequate provison, you can claim for you losses.

The buyer's complaint may well be genuine, but why not ask him to back it up with photos?

For sure, Paypal are useless at looking after the interests of sellers. For this reason, I do not accept Paypal payment when selling any high value items on eBay.

I'm sorry, you must be feeling pretty fed up with your prefdicament, but this Paypal and eBay exist to make a fat profit and has become adept at swerving any liability, lumping this entirely on the seller. Bang out of order IMHO, given their excessive fees!!!

Yes, I paid extra to be covered up to £500. Can I find the bl00dy proof of posting receipt? Can I b0ll0x. Gah!!!11!

I have emailed the buyer asking for photos of the damage - I'll likely need them anyway to claim compo from the Post Office (if I can find the damned receipt!!!).

They were packed as securely as possible and must have taken a fair hit somewhere along the delivery chain - each cylinder was wrapped up in a cocoon of bubble wrap - they were also all in their original cardboard tubes which provide a fair degree of protection by themselves.

Right. Off to carry on turning the house over trying to find the receipt of posting.

I'd tell him to post back the broken ones and refund that proportion. 9/57 x £336 = £51. Ebay considers it acceptable for the buyer to pay return costs, personally I think the seller should pay as they didn't provide the goods, your call.

Well, found the receipt (thank the good Lord!!) which shows enhanced compensation up to £500. I'll call Parcel Force tomorrow and see what happens. Still waiting for photos from buyer....

Not bothered about getting the broken ones back - as long as he can provide photographic evidence of the damage. Nick - that was the figure I arrived at too.

57-(9-3= 45

45 divided by 57 = .7895

£336 x .7895 = 265.27

£336 - £265.27 = £70.73

=£71

scu98rkr - I see where you're coming from but the '-3' bit in the first line is where the sum falls down. The three empty boxes were a freebie, thrown in to sweeten the deal - unfortunately, the guy who bought them doesn't speak much English and I'm struggling to get this concept through to him...

Yes but he does not realise this as he has not counted the total number of boxes.

All he knows is there are 9 broken and 3 missing 12 in total.

He hasnt twigged that there are 59 + 3=62 boxes he is assuming there are only 59 boxes.

Im not saying he's right by the way. Your asking where he has the number from, and Im certain this is where he has got the figure of £71 from.
