Yes I am aware of this - I just don't see where it fits with the discussion!

An assault charge [i]is[/i] something to worry about, as a conviction for assault can cause numerous problems for a person in terms of their career especially. Such a thing can prevent you from working with kids or vulnerable adults, and go against you for a whole plethora of other jobs. Not something you want on your CV...

The Crown Office said it was not in the public interest to prosecute the pair.

which is what i predicted / suggested would be a reasonable outcome. Not that no assault took place.

However, the Crown Office now has no plans to proceed in either case.

Last week the train conductor who featured in a video returned to work.

It is understood Alan Mitchell, 63, had been on sick leave.

His employer First ScotRail would only say that Mr Mitchell had been on leave since the incident.


So both get off and the conductor demonstartes hes not fit to do his job. Winners all round.

Big man is investigated costing money and putting others off from stepping in when anti social behavior is seen. Double lose.
63 yr old Mr Mtchell has a month or so on [s]holiday[/s] the sick and who pays? Lose.
