For 3 months after we left his crap little flat the wife has been trying to get the £1000 deposit back. Given him evidence that bills, rates etc have been paid. Wife has been to his office about 6 times, phoned, texted etc all to no avail. She went back to his office today to ask nicely for a cheque and he shut the door in her face and called the police to remove her because she was trespassing. The Police of course took the wife's side but couldn't do anything. Even Stockport Council say the guy's a W***ker and are pursuing him for non payment of rates.
What's the concensus on how to get the deposit back and any advice on sorting the tosser out.
small claims court's your answer - anything up to £3,000.
make sure you've got all those proofs you mention and take the ****er to court.

Oh my very word pallyally. I think I know the very guy you're speaking of and if it wasn't for annual billing and the C/tax systems being closed down from 4:00pm today until 10:00am Monday morning, I think I might have been dealing with yet another of his accounts/properties this afternoon.

See if hes a member of a trade assosiation, and complain,
is he a ltd company if so companies house will have his home address, call round early morning and about 4.00pm when a ll the neighbours are bring the kids home and chat to them, then go round about 9.30 pm ,
find his phone number and repeatedly ring him at various times, hes a buisness so he cant refuse to answer as it may be a customer.
Second thoughts, the balaclava won't hurt him enough, so buy a baseball bat instead..

Aren't deposits protected by a government scheme now? Go to them. If he took it and didn't put it in a scheme, then he's in deep doo-doo anyway.

I'd just issue a claim letter then sue by Small Claim.
Learn the lesson never ever leave a deposit with a landlord never had one returned just used to stop paying rent when I was leaving as you needed to be 14 days in arrears to take to court etc and by the time they have done it all you have left anyway.
Small claims court and then retribution if you are that type of person but I am not.
Small Claims Court....yes. However, as Flaperon points out since April 2007 all landlords must ensure that deposits are protected under a Government Approved scheme. This is to avoid deposits being retained for spurious reasons. Need to check this out first. Might be faster than raising a small claim. As usual Singletrackworld is not short of advice. Basically if you signed an AST after a certain date (can't remember exactly when)they are legally bound to lodge the money with a deposit scheme. Failure to do so leads to a fine of 3x the deposit plus the original deposit back.
