[Closed] potential sale of goods act issue - advice please

i bought an exposure maXx daddy front light today from evans and when i got home to fit it the bar mountin g bracketwas broken
i rang evans and they said that if they had a bracket in the shop they would replace it - fair enough
however the guy from evans finished off by saying that "if they did nt have one in the shop, well we will have to cross that bridge when we get to it and they may have to send it back"

i thought my contract was with the retailer and if the goods were not fit for purpose i could have a replacement or a refund

what line should i take if they suggest that that they have to return it?

therewas a guy in the shop while i was purchasing my light complaining about a specialized bike he had bought - "you need to take it up with specialized yourself, its nothing to do with us"

Your contract is with the shop. If its faulty you are entitled to a refund, or repair/replacement - your choice. End of.

yeh i thought that but how do i convince the guy in the shop?
i suspect itbe;

shop assisitant "its our policy to sendit back and that is all i can do"

Well tell him that you are aware of your rights under the SOGA, and if they are not prepared to comply then put it in writing to the manager/head office of the store. Key thing is though not to loose you rag as tempting as it may be, keep polite and formal.

Hi Gooner

Ask to speak tpo the manager and tell him that you've been in touch with Consumer Direct ( http://www.consumerdirect.gov.uk/) although no need to at this stage and that you know you're well within your rights to demand a replacement. They haqven't got a leg to stand on.
