You can always hedge your bets – being overtly racist will be offensive to most people. But it won’t be to some.
So you can’t, inherently, ‘be offensive’. You can say things that other people take offence at – and to them you’re being offensive. But that’s not actually the case.
E.G. I don’t find bad language, of any kind, offensive. Not in the slightest. My sister, on the other hand, dies a death from a few words. Yet, I find her spending habits offensive.
You can’t legislate for what people take offense from. So no. You can’t “be” offensive. Not really. You can just hedge your bets if you really want to try to offend someone. But you’re just trying to provoke *them* into taking offense.
