MegaSack DRAW - This year's winner is user - rgwb
We will be in touch
the gf got a speeding ticket recently - 39 in a 30 zone. she was picking it up from the garage after it failed its MOT, is declared as being off-road (SORN) and she has no insurance...
Firing squad....
HTH
doesnt help, no
she should pay the fine pronto and send her license in for points and hope nothing further happens
but it probably will
I'm fairly sure youre allowed to take your car back home, even if it has failed its MOT.....
i'd be suprised if she doesnt get a court summons.
The MOT thing is probably fine, the no insurance isn't. If the police do a check then that may well be an additional fine/points.
My experience is that all the various depts do not always have as much contact with each other than you think.
If you have since sorted the MOT etc you will be fine.
BFITH - As I understand it you are allowed to take it to an MOT test centre for a pre booked test but that's it.
If it was a fixed camera, pay the fine quick and hope.

It's the driving without insurance I'd be more worried about. There are expections for driving without an MOT, as you say, but never for insurance.
Woah, like ten replies and no one's judging anyone yet for driving without insurance!
Whatever happened to the STW we knew and loved...?

It's early days. I think most people are at lunch.
yeah it was a fixed camera so we're hoping that the police & dvla wont cross reference and it'll just be a fine & points. we're scrapping the car now anyways.
if it went to court, then what??
Hopefully enough of a stiff penalty such that she'll reflect upon her actions and not repeat them 🙂
yeah the insurance thing is the worry - she's not that bothered about the points or even losing her licence for that matter.
6 points, couple hundred pound fine, maybe (quick google search)

I wasn't judging....just being unhelpful 😀
just being unhelpful
Ah, what a relief. That goes someway to restoring my faith in this mass.
What did it fail the MOT on?
[crossed fingers]please say faulty brakes or tyre tread depth below legal minimum[/crossed fingers]
If they'd done all the relevant checks, I imagine the NIP would have mentioned no tax/insurance. Pay up, send the license in and hope for the best.
Alternatively - and in no way do I endorse this course of action - are you insured for the car? Even 3rd party via your own car insurance would do. You take the points and your gf owes you BIG TIME. Insurance companies generally aren't too bothered about the first 3 points on a license, so I wouldn't worry about it putting your premium up.
I have no sympathy. Supposing she caused an accident? Another party would presumably be unable to claim?
Lack of personal responsibility imo.
I would imagine that being declared SORN and having it on the road isn't going to go down well. I dint imagine that there'll be MOT related dispensations for that.
Even 3rd party via your own car insurance would do.
If your insured to drive all cars third party as part of your insurance on your own vehicle, you're still not allowed to drive another car that doesn't have it's own insurance cover. You're not allowed just to get in to any un-insured car and drive it.
Either you are an excellent troll or you girlfriend is a proper ****. I hope that it's the former.
5 points stuck on her licence for 4 or more years.
100 quid or so fine.
Stupid insurance quotes for a while.
You would have got a better reaction if you said she knocked off a few cyclists on the way.
Hur hur hur, she can 'knock me off' any time she likes.
Probably a pending IN10 as well an SP30 and loads of insurance companies turning her down for 5 years!

a few minor things really, bit of corrosion on the chassis being the worst. the NIP does mention about a possibility of cross-referencing for insurance but they evidently haven't done so yet.
i don't have an insurance policy so me taking the hit is out of the question.

good job that's not what i came on here asking for then eh!!!!
i bet 3 points and 60 quid fine, the norm
i got done for no road tax, dvla camera (car was out of MOT and uninsured) - i only got done for the lack of road tax
so why did she drive it back then?

suppose i must be a troll then?

hope so! time will tell...

Not sure about this. My insurance policy allows me to drive ANY car, whether it's insured by someone else or not. I'm just not allowed to leave it anywhere other than private property, due to the fact that as soon as I get out it's no longer insured and so can't be left on a public highway. i.e. I could legally drive my neighbour's uninsured car from his drive to the MOT station. I guess it's down to what the individual insurer says.
you can drive TO or FROM an mot test centre where you have a pre arranged appointment for the test.
this can be done whether the car is sorn or not.
however, you still need insurance.
my mate imported a motorbike from usa, he drove it to the test centre for its first mot with no number plate, got stopped by the police, didnt get done as he was completely legal.
getting stopped 5 miles in the opposite direction would probly have a different result i would think.
pray she just gets 3 points and the 60 quid, then as long as you have a clean licence you can rip the piss for evermore.
no insurance, driving at 39mph (so speedo most probably reading > 40) in a 30 limit....
not the sharpest tool in the box ?
My insurance policy allows me to drive ANY car
any car not owned by you is the normal wording to stop people owning 10 cars on one policy.
Not sure about this.
Thought the point was that the car has to be insured with a minimum of 3rd party to be driven or even parked on the road and therefore must have insurance in it's own right. Your insurance company cannot negate the law by insuring you to drive any car - it's nothing to do with them. Otherwise, as soon as you park the car somewhere and get out it suddenly becomes illegal again.
I'd double check with your insurance company if I were you, because I nearly fell in to this trap.
suppose i must be a troll then?
You just made all this up in order to get a reaction?

No, I think he's saying his wife isn't a ****.
She really is, though. And a proper one at that.

Just to add, if it was a rear facing [s]speed[/s], err, 'safety' 🙄 scamera, 'they'won't be able to i.d. the driver, so, as above, if you are covered on the insurance, say it was you driving, & you were on the way to the MOT centre. If it was only a few minutes between the MOT centre & being 'flashed' this could be feasible....
As already said, a car with no MOT can be driven to the MOT centre, but what if you, ahem, 'got lost' on the way to the place, & drove around a bit before you found it ? This 'explanation' could be used if 'they' said that due to the location of the camera in relation to the MOT centre, it showed that the car was going away from the centre at the time...
Bastard 'Safety (S)Camera Partnerships' make my piss boil....**** all to do with road safety, & all about revenue. And, yes, I know, if you weren't speeding, you wouldn't get fined etc etc.
good job that's not what i came on here asking for then eh!!!!
This is STW, it was inevitable that you would get some flak.
pet hate of mine the driving with no insurance thing. TOTAL lack of regard for anyone else or the consequences of any accident even if not 'your fault' as such i.e. mechanicla failure (though possibly more your fault on an MOT failure).
Friend just had his car rear ended by an uninsured unemployed driver. Police involved, expected 6pts and £200ish fine, payable at 50p a week. Great system as that's a definite deterrent. As to the OP, I'd need to know why no insurance before getting on my high moral horse but as car was SORN'd I'm guessing no insurance was deliberate in which case I'd suggest compulsory organ donation in a typical STW way (and I mean her organs nor me donating one of mine of any shape or size to her!). Just to be clear I mean vital internal organs.
As already stated you can drive to from a pre booked mot while the car is SORN as you need a valid MOT to get the disc. What you can't do is have no insurance as you don't need an MOT or disc to get that.
