Hi there, I'd really appreciate a little help, hopefully this is an easy answer for someone familiar with these contracts.

Apparently, I should agree to:

"Pay all cost charges and expenses (including solicitor's costs and
surveyors' fees) incurred by the Landlord in respect of and incidental to
or in contemplation of the preparation and service of a Notice under
Section 146 of Property Act 1925 and whether or not such Notice is
actually served and notwithstanding that forfeiture is avoided otherwise
than by relief granted by the Court."

I understand what this type of Notice is, but I'm a bit baffled by the bit in italics.

Does it say that I have to pay for those costs even if the Landlord messes around on spurious reasons then doesn't even bother to finish it off?

Does it say that the only way I can avoid those costs is the Notice goes through the whole process, I then contest it and win in court?

Any help would be hugely appreciated.

Thank you!

Ed

"incurred by the Landlord (acting reasonably) "

Would be my mark-up. Difficult to see how that could be objected to. You're right, that's pretty wide.

just cross it out, I don't know why people have issues with crossing out sections of agreements they don't like, I'm never challenged on such activities

An alert agent will always respond to crossings out with: "I am too stupid to understand the implications of what you've just crossed out, so I will react to you doing so by refusing to accept your suggested amendment despite the fact that you are paying me £200 to "prepare" this agreement, which is admittedly more than the hourly rate of a genuinely superb solicitor at all but the priciest City firms".

BD: that's part of the reason I'm letting from a private landlord!

Cheers all, good to know I had the right end of the stick, I shall make appropriate amendments.

🙂

you know, they never have, I'd just cross bits out and say, I'm not happy with that, ok?

in my experience most lettings agents couldn't give a damn as long as they get their idiotic fees paid
