I've handed in my notice at work to leave at the end of the month. I've just been told I owe them 40 hours holiday wages and they are taking them out of my wages on Friday. They pay us on the 18th of the month (aug) but you are paid for the whole of that month (aug). So get paid for days you haven't worked yet.
I'm also on a bonus which is paid a month in hand. Is there anyway I can demand my wages this month with out waiting for it till next months wage to come in when I will be in a new job ?
No.
If it's a bonus don't you have to still be working for the company to receive it? Are you sure you will be eligible?
Yeah the bonus will be paid. But not untill the September pay packet. It will just be bonus and overtime payments
Getting paid a month after you leave a company can be a pain in the arse (tax after issuing a P45 can be troublesome) so I'd certainly ask but frankly asking 3days before payday is a bit much and were I them I'd say no.
Can't say I really follow what you're asking. On the holidays thing, generally you accrue a certain amount of days per month that over the year adds up to your annual allowance. If you've already taken more holiday this year than you've accrued then they're right to claim the extra back. What you've accrued should be up until the end of August if that's your last working day.
I'm not really understanding the bonus thing. Do you mean demand your bonus for August without waiting until your September 18th pay cheque (which you won't be getting anyway)? Probably depends on the terms of the bonus, if it's guaranteed based on targets being met (and you've met those) + there's no clauses around not being eligible if you've handed your notice in then I would have thought they'd have done a separate 'settle up' payment to you at the end of the month.
I'd recommend that you dig out your contract of employment and read through, these terms should have been set out from the get go.
Please also take time to look at your payslips for September, as the tax calculation of a payment after leaving is often something employers get wrong. Your September payslip from your previous job should show a tax code of 0T (month 1), otherwise you may end up with a sizeable adjustment for tax further down the line.
assuming are eligible then maybe your payroll people could treat your bonus payment as a one off "advance" pay and then simply retain the bonus from the september payroll as your repayment of the advance (may not be 100% legal but probably is if you expressly agree it ) an advance would be processed separate to the payroll which has probably already been done

It's not just an adjustment it's a possible fine too. I managed to escape that part but I still got the tax bill from three or four years ago..
