Yeah, I know I should ask a solicitor and I will do. Thought I'd see if someone here could also confirm my gut feel about this...

My sister has lived with a bloke for 8 years or so. He owns the house (the mortgage is in his name only anyway).
They're recently had a kid.
He's always been a bit of a bellend but the other night things got violent and he was arrested then released the day after.
She's moving out at the weekend and has asked me (cos I've got use of a van and I'm her bro) to help her move some of the furniture to her new place.
The furniture includes the 3 piece suite and some large items of bedroom furniture.
In her words, they paid half towards everything in the house.
He will be out at work at the time and significantly he knows nothing of the plan to remove the furniture.

My instinct tells me that this is illegal and she would need his consent. I'm also concerned that everyone will be in trouble, including me.
I'm using the sign-written van from work too, so if this is illegal activity then I doubt that my employer would be too happy.

The police officer apparently told my sis that 'it'll be reet' but I'm not so sure that this is correct (or whether she's heard what she wants to hear).

Does she need his consent or not?

No. He has to move out. Stipulate HE leaves. I suggest a totally different tact, he is asked to leave and Police will be called if he doesn't and if he comes near the house.

Ring the CAB, and explain your circumstances. This isn't the right place to ask

You need real advice. I certainly would not be using a works van for this.

She will have some rights over the house as well I would have thought
