We have a problem where we live with an embedded property factor, who doesn't do the work, charges ridiculous sums of money for very little and has been removed from our deeds thanks to a court case. However, they are now going after folk saying that there is an implied contract.

Has anyone tackled this before? Is there anything in any court cases, which could almost be seen to set a legal precedent?

IANAL, but in mentioning that, you could be accepting that there WAS an implied contract to break.

But, in initial verbal negotiations, I'd say it's a good thing to counter with.
