how do i kill off a tree with out digging out the roots?
can i cut it off at ground level then treat it with something to stop the roots growing anymore.
Nuke it from orbit, it's the only way to be sure.

Depends on the tree. If it's an evergreen then generally removal of foliage, i.e. cutting off at ground level, will suffice. If it's deciduous and a particularly vigorous grower then you may need a chemical aid.
For the sheer fun value though I can recommend the Capt's solution.

Cut the branches off, then cut from the top of the tree down so the trunk is in manageable size peces. Hire a stump grinder from a tool hire place and buzz it down to 12" below ground level. Replace the hole with topsoil and a wee roll of turf and bob's your uncle. The roots won't do much and will just rot away eventually.
This is what an arborist/gardener would do.

Just cut it down, then treat the stump. B&Q do a good powdered stump killer that seems to do the trick.

Diesel will do it, with the slight downside that nothing else will grow there either.
Just dont let the EA catch you or they'll have your nuts for pouring diesel in to the ground.
