Just need a bit of advice before i start asking questions of a retailer.
Purchased an item on-line, and paid. Got a message the next day stating the item was out of stock and they would message me when they had stock, no mention of when this would be.
Thought nothing more. Happened to check my account for another reason and they have charged me (its a reasonable cost), now my understanding of the distance selling regulations is they are not allowed to charge you until the items are being dispatched? Is this correct?
Had a quick look on the trading standards website, but couldn't find anything.
Anyone know, or even better have a link to this information?

Sadly not. Some online payment gateways only operate on a pay now basis.
They have 30 days to deliver your item from order though. However you can cancel your order at any time of course so that could solve your issue.
Of course it doesn't help with sites that don't have stock updates. It is a pain for the user as the assumption is that things are there.

They're not supposed to though, and IIRC they're only supposed to charge if in a position to dispatch (not if they don't know when they're getting stock).
We recently switched to pre-auth for transactions - a lot of products we sell like frames for example, are never going to be in stock or aren't due for a while.
Collecting and refunding is a PITA
You've also got 7 days to send it back for whatever reason. So if you buy it elsewhere then they send you another, just send it back.
