My girlfriend bought a halloween costume from a local shop. The picture on the front shows the model wearing the costume & accessories one of which is an apron - it looks how you'd expect an apron to look on a normal sized person.
The actual apron supplied, bearing in mind this is an adult costume would look small on a 5yr old. She went to take it back today & the shop would only offer store credit - not a refund. They have more of the same costume in stock & all suffer from baby apron syndrome - can they only offer store credit? Surely goods aren't as advertised?!
It's not a huge amount of money - but that is hardly the point..
Not worth losing any sleep over IMO. I see no easy way to get your money back as its not an obvious sale of goods act issue. Trading standards?
was it "french maid"? I don't think they're supposed to make it outside the conservatory?

You'll probably find some kind of caveat on the packaging stating that the photo may not be representative of the contents. If no such caveat exists, you may have some form of a claim, but it's probably not worth it for a small amount.

That's what I thought... there is nothing else in the shop we want just now - so it'd be nice to put the money to something that we need.. like food.
Teh shop only has to refund if the product is faulty. If you change your mind they don't have to do anything. Offering a credit note is goodwill only

Except it appears to be different to the description, where they are entitled to a refund. SOGA Section 13(1) Sale by description.
Under what bit of law Don? Its not obviously under sale of goods act?

Not convinced by that Don. I bett there are weasel words on the packet and it would apper to me that the "sale by description" is not what happened here
