..........buying a used Nobby Nic UST tyre off here that won't seat? Bought it about 2 months ago off the classifieds for a planned build. Frame came yesterday, so started bike build. Mounted tyre for first time last night but keep blowing off rim at same point on tyre. Rim is fine but tyre just comes straight off at low pressure when trying to inflate.
Asked seller for a refund due to faulty tyre but refuses due to length of time I've had it.
New NN mounts fine.
What do you think?

I had this problem with one i ahem over inflated when trying to seat. it blew off the rim making me look like i had been in a gay bukkake porno and then the tyre was permanently stretched.

Its pretty hard to ruin one like this so he must have known it was a duffer when he sold it you.

Ask again i say.

I'd say you would be lucky to get a refund from a shop 2 months after purchase for a tyre - and you've even less chance from a private sale where caveat emptor applies. If it were me the only way I would accept it was my fault would be if I knew it was damaged when I sold it to you, and I think (1) its unlikely anyone would sell you a dodgy tyre with any intention of refunding it if you complained (2) its even more unlikely that anyone would refund you 2 months later (3) people rarely admit they have done anything wrong.

can you damage tyres in shipping or storage?

You mean the tyre is popping off the rim as in popping over the rim - what rim are you using? Surely the only way that could happen is if the kevlar bead has stretched, or even snapped?
