Knocked off bike, what now?

Just been taken out coming down a marked, supposed "cycle lane" basically bike logos painted on the road .. but it's purely because of the potholes. Driver swerved suddenly to the left (I was almost past her) clipped me with the front bumper and over I went. Bike seems ok (Tripster, my lovely Tripster!), except bars and lever. I do this same route every commute and only now because of the untreated potholes ... Any smartarses who are thinking of typing something along the lines of don't go down the inside even on cycle lanes, just don't bother. Thanks. So, is this the driver's fault, or the council for leaving the roads in such a dangerous state?

Nothing stopping you! Your claim so far seems to be for property damage, so add in the injury/rehab claim to a new personal injury claim.

Wouldn't be able to go back on it now, told them no injuries to claim for. Really don't want to be dealing with those insurance f-wits any more than I have to to be honest. Just want my money, sort bike and forget it.
