    I've tore something in my knee walking on the loose gravel/pot holes in the dark on the Uni car park. My foot gave way as the surfaceis loose and sandy/gravel.

    I'm gutted as I'll be out for ages now! 👿

    Sitting at home with an ice pack.

    Rang the transport dept but they were not interested.

    Tempted to call an injury solicitor but just want my knee in order.

    Ok angry-dodgy surface with lack of maintenace-who's responsible?

    Blows dust off the guitar…couple of months mending (A&E say the cartilidge is torn and will need removing) and sells bikes…

    Ignore all the self righteous crap talked above. The Uni has a duty to maintain its premises and to provide adequate lighting. Potholes are indicative of them having failed in that duty. Why should you be out of pocket due to their failure to do what they are legally obliged (and paid) to do? That is why they are insured.

    I am a solicitor who specialises exclusively in defending insurance claims but in your shoes I would claim. The injury could have long term effects or you may need better/earlier treatment than the NHS will provide. I suggest you contact a solicitor. I can put you in contact with a good one.     Slips and trips aside, the carpark, as a public space, must have been designed to be lit, there are minimum stands to be maintained, not just to stop you tripping over tramps but also to discourage you cars from being burgled and your fellow students from being mugged and raped, and to allow them to go about their business without fear.

    Regardless as to how people might feel about our compensation culture I would have expect more than a shrug from the university management. I would expect them to shit themselves.

    My knee-jerk (sorry!) reaction is to say HTFU, but if the surface is badly maintained, the area's inadequately lit and you could reasonably be expected to need to walk across it then I agree with PaulMc.

    When it was normally lit (or in the daytime) didn't you notice that it was uneven and had potholes? Maybe you should have adjusted your walking accordingly?

    Thanks Paul, I left a message for injury specialist who got the money for whiplash physio a few months ago when a driver on his mobile smashed into me and drove off. He said he would look into it even it just pushes the uni to get the land fixed so it doesn't happen again to anyone else.

    Students and staff have beem complaining and campaigning to get pot holes fixed for 2yrs…and they just used sand.

    I've got an appt with a sports specialist on Friday who is really good who worked with the England rugby team. I have Bupa cover and the NHS is shoddy as I worked for them as a Heamatologist and I was told to cut corners for a lot of patients.

    I've just checked my email with transport dept apologising and promising to fix the lights and fill in the pot holes.

    Parking cost £120 per year up front.

    It wasn't pitch black but the floor was slippery and has been like that for 2 yrs. The floor gave way where it's falling apart and I was being careful!

    Anyway enough of the yelling at each other, and thanks for the great advice folks. Hope to back on the bike one day soon!

    pathetic claim culture shit. why don't you just accept that you fell over. 'loose sandy/gravel'? what do you ride your bike on?, going to claim for that if you fall off? Do you really want to blame somebody else for your misfortune (cos that's all it is really).

    Thanks nonk, and agree I'm not into the claim market but I want to make sure the land gets fixed even if I have to get the student union to campaign for it. I think I was lucky as it could be a worse for someone else.

    And I didn't fall over Rob, I slipped opening my car door as the floor surface broke apart. I was wearing not slip boots too! Maybe If I crawled like spiderman I'd be ok.

    If the Uni does nothing to repair the land after this and is liable and if I have a legal case then I may well indeed claim if I'm within my legal rights.

    I'm glad I didn't buy a new carbon road bike btw!

    Claim culture sucks, but we're making judgment on the situation based on two lines in the original post, I suppose that's what's been asked for though.

    I'd suggest getting good advice from a professional, and make sure you don't bullshit. If there's a genuine fault that caused you injury then that's why they'll have insurance.

    Question you have to ask is if it's worth it – misery and stress caused by court cases etc compared to compensation to get a wrong fixed (your knee). If you're looking for cash for a new bike, well, that's not great.

    liable and if I have a legal case then I may well indeed claim if I'm within my legal rights.

    so did you cut corners as a haematologist or witness it taking place and did nothing to stop it, if so there might be a few patients/family wanting to speak to your claims lawyer.

    so as before did you tell your employers to F off and did your job properly or did you accept or even turn a blind eye to others doing it. either way what did you do to stop it. after all the NHS is well shoddy did you do anything to improve this view that people have?

    i dont know your story but if you did nothing there might be some kind of symmetry between being asked to cut corners in your haem dept and leaving the job then the driver on the mobile ****tting you and driving off without leaving a name?

    please tell all, do you think i might get a juicy finders fee from the claims lawyers against your old trust. if i do i will share 50/50 with you as a matter of courtesy, ill prob split you a bit more if you end up on the wrong end of a court case due to negligence etc.

    I've worked for the NHS for 20 years now never been told to cut corners, patient care is considered the highest priority and not profit making.

    You need to be checked out though as not sure how they could tell you had a torn ligament in A+E.

    God help them if it snows or gets a bit icy.

    Sorry I'm a bit old school. I diislocated my knee whilst running in a park, I stood on that bit were the tarmac meets the grass and went over, properly dislocated my knee and missed a tour of the Alps.
    No ones fault but my own.
    If I couldn't see where I was putting my feet I'd be a bit careful.

    And to the solicitor, how is he out of pocket?

    Car parking fees double next year due to compensation claim solicitors.

    Anyway the potholes appeared overnight due to the heavy rain didn't they?

    Another thing, is it a laid surface car park that's in disrepair or just rough land parking? i.e like a car park at a mountainbike event.
