    I *think* from what it says, that I fill it in *only* if the defendant does not respond or cannot be contacted, and get it to the court two days before proceedings….?

    Form 11 is to notify the court of a failure to respond to summons.

    Have you/sheriff clerk already served the summons? If so, how long until the hearing?

    Court date is December – we just received confirmation this week that they are trying to serve summons on defendant.

    Once they have served the summons, there will be a date by which the defender has to respond. After that date has passed, if they still haven’t responded, you fill in a Form 11 and lodge it with the court (as you pointed out, no later than 2 days before the scheduled hearing).
