1. It's not visual, it's a joke about picture. If it was a visual joke, it would just be a funny picture.

I disagree. Saying 'Look, Mr KFC has a big head with small arms and legs' would be an observation. The way it was framed with the line 'Fried chicken implicated in extreme case of hydrocephalus.' makes it a visual joke IMO (ie, you have to look at the picture to get the joke).

You can always hedge your bets - being overtly racist will be offensive to most people. But it won't be to some.
So you can't, inherently, 'be offensive'. You can say things that other people take offence at - and to them you're being offensive. But that's not actually the case.
E.G. I don't find bad language, of any kind, offensive. Not in the slightest. My sister, on the other hand, dies a death from a few words. Yet, I find her spending habits offensive.
You can't legislate for what people take offense from. So no. You can't "be" offensive. Not really. You can just hedge your bets if you really want to try to offend someone. But you're just trying to provoke *them* into taking offense.
