So, if your roof tiles get blown off in a storm, are you liable for the damage they cause to people or property?

When my ridge tile got blown off onto my brand new car my home insurance wouldn’t pay the claim as it had damaged my own vehicle.
They explained that if it had been someone else’s car then they would have paid out.

This was several years ago so unsure if it’s still relevant.

I think that if the roof was known to be in poor condition and you did nothing about it then yes however if there was no indication that the roof was in poor condition it becomes "an act of god" and therefore no liability

I would think so. That’s why most home insurance policies have third party liability, in our case I think it’s two million pounds.

Technically it's about negligence. Your policy covers your legal liabilities to pay for damage to other people's property, its not automatically covered the way damage to your own property would be.

Have you done all that a reasonable person could have done to prevent the damage occurring?

If you check your roof, there's no obvious problems and then a storm rips tiles off, then you probably haven't been negligent and you, and your insurers are not legally liable to pay for any resulting damage.

If you know you have lose tiles and do nothing about it, then you would be.

I suspect that practically, most insurers pay as the cost of establishing the facts and arguing the toss aren't worth it.

We got paid out after a half tile from next door hit mrs Gs car on our driveway not spoken much to them since I had photos of the poor state of the roof so not sure if they or their insurance paid up either way you should not be out of pocket.has this event happened yet?

Although if your roof was the only one, say in the street, which lost tiles, it would be hard to argue it wasn't due to being in poor condition.

Your car insurance covers your car, sounds like I’m being cocky but that’s how it works.
