live in the middle of a terrace ,no shared chimneys but the chimneys are built on the party walls (making sense ?) neighbour has had a dish installed on to my chimney but the side facing there roof.Cheek I thought, went to have a 'word' and they say they are legally entitled as that part is inline with there side of the party wall.Is this right ? They did repoint it recently and its a good job, dont want to fall out but would like to know where I stand searched for a few hours but still unsure any help ?
Common Walls are normally shared property. You need to check whether the chimney wall is within the line that devides the property. Anything that crosses the line is effectively trespass - including vegetation and tree routes
Satellite dishes will be considered de-minimis (or minor changes) to a normal building type - though in law you aught to be protected by the Party Wall Act - where an independant surveyor adjudicates between one party and another, over building works made on or within 3 meters of a party wall
I'm afraid that a satellite dish isn't normally worth contesting unless you live in a listed property or a conservation area or can prove that that it's damaged some aspect of your house
If the above is not relevant & If they've not crossed the common boundary, they've not done anything wrong I'm afraid
The dish may be on their side but the screws holding it on must be protruding over the line onto your side. So offer them a compromise, the dish can stay as long as the screws are removed. 😀
So, you were quite happy for them to pay to repoint your chimney, but not for them to bolt a bit of metal to it?
lateo think the chimney wall that the dish is attatched to might on there side of the divide between the party wall (assuming the party wall divides in the centre of the wall)was looking for some advice as to ownership of that face of the stack, aP as to the pointing, I was never asked and would have preferd to do the the work myself (The pointing was fine anyway) looked like the roofer was finding himself some work to me !
