Just moved out of a shared flat with both my name and my flatmate's on the tenancy agreement. He's staying there; I've paid the rent up until the 24th.
Got a phone call today asking for me to return my set of keys. Explained that I'm hanging on to them (with the right of access and storage that implies) until the 23rd at the earliest, or indefinitely until a new agreement sans my name is drawn up.
Flatmate not happy about this because he'll effectively sign back into a 6 month notice period.
He suggested instead a letter absolving me of responsibility for anything at the place, which I don't think will carry any legal weight - for example, if the place gets broken into and trashed, or he can't pay the rent for whatever reason.
I assume that in a joint tenancy I can simply give notice to the landlord in writing (he already knows) and the agreement will legally evaporate after the notice period.
Bit complicated, but certain that if I just hand over the keys nothing will be done...
Presume this is English?
I dunno about the law (I only know the proper stuff) but I'd want something from the Landlord for sure.
Steve Austin knows his stuff.
Cheers al.
Simply put. You are jointly and severally liable for the rent, any damage etc until the tenancy is correctly ended. I can tell you how to end it correctly, but i need more information.
Lots of correct legal advice / guidance if you click my name

If it were me, i'd have given the landlord written notice in time to comply with your contract terms. This is usually a minimum of 1 rental period (i.e. payment month).
