I have a contract with my employer that after 6yrs says that I have to give him 3 months notice; he is now asking me to sign a new contract that says that I have to give 3 months after 5 yrs. As my 5 yrs is up in April I am reluctant to do this as I would like to change jobs, although in the current climate that may not be so easy. Do I have to sign the new contract and what would be the outcome if I refused? Cheers

Check your current contract, I'd imagine it says they have the right to vary your contract by giving you sufficient notice.

Sign it, then when you want to leave say you're going to work for a competitor. Bingo, garden leave! ๐Ÿ˜€

You need to remember that if you have to give them 3 months notice then they have to give you three months notice if they want rid too.

Employers recognise that people have notice periods and are almost always accepting of that. If a potential employer wasn't happy with you having to give 3 months nptice then I'd be questioning whether I wanted to go work for them.

In practise, depending on workload & how easily they can pass on your work to someone else, you'd probably get away with just giving them notice period of one full pay-period (so i'm told). I guess this could work out as just under 2months or just a month (if you're paid monthly).

Thanks for the advice, know one in my industry give 3 months notice and it would make it all most impossible for me to get another job.

In practical terms - an employer would be daft to force somebody who clearly no longer wished to work for them - to work out that kind of notice period. We have 3 month notice period in my workplace and in reality a mutually accepted period is given. Varying between 4-6 weeks.
A prospective employer is also not going to have kittens if they have to wait an additional 2 weeks.
