So do the CC company reclaim the balance from the original dealer? If so I'm hoping WBACs offer is even more derisory than usual - I'd make sure they are fully aware of every defect!

Absolutely!  And perhaps be a bit "clumsy" around the car and put a few dings in every panel 🤣 

But great news, Renton.  It's just a shame the car was mis-sold to you originally, that garage needs a equally shoddy review also.

Fantastic news. I assumed they used their weight as you'd put the deposit on a CC (not all) so they can go after the full value ?

Must say, that retailer didn't give me the right vibes when we went poking about for a Traveller/Vivaro Life etc... some fab cars up front, but the digging about in the rest of the 'showroom' the issue was the vehicles I was after had some major bits missing from all of them - they had about 4-5 in stock (for a rare vehicle).

Another lurker-follower here happy that you got this outcome but sorry you had to go through the wringer to get there. If there was any justice they'd have to compensate for stress caused. Well done for sticking with it.

Also hoping I never have to buy a car again, though my 17 year old Berlingo probably hasn't got another 17 years in it.

What an utter PITA that turned out to be!  Completely unnecessary on behalf of the seller - I hope it costs them enough to make it equally painful. 

I know that there are many, many car purchases that are 100% uneventful but this thread reinforces why I rarely change cars (average is about every 10-12 years) and buy used from a main dealer with a big warranty.

Glad you got sorted in the end.  Fingers crossed for the replacement car 😬

Do you know if it's the credit card company standing the bill, or the dealership? I really hope it's the latter. 

Are you now considering hitting them with small claim for the repeat trips for unsuccessful repairs, your time spend dealing with the problem, any other out of pocket expenses? You may not have the appetite for it, (fair enough) but it'd be nice to really rub salt into the wound. 😈

The refund is coming from the CC company. Again, no contact made from the dealer. I will be leaving them a factual review.

Not only that, but as a business they'd be obliged to attend court in your locality, not theirs.

Given they didn't even respond to the cc and that was regarding the value of the car,  id doubt they'd even turn up to defend a small claims court case.  So it would be found in rentons favour but then getting them to actually pay would be the painful part.

AIUI the section 75 claim can include out of pocket expenses so you should be using that as it’s already in progress..

Great news. Don't do anything to lower the WBAC offer - just take it as it is and answer any questions but do not volunteer anything. You have been dignified and sensible throughout this so finish it in the same way. Of course leave an honest review of your experience once all is done and dusted.

Well done for sticking with it.

it's not your concern now but it's interesting that the cc company have instructed you to wbac it and get a partial refund from that sale and will top up the rest - it suggests they aren't going after the dealer directly - otherwise they would have to return the car and leave the dealer in the same (ish!) position as before you bought it - ie reversing the transaction. Perhaps that route is more hassle than it's worth to them given he's so unresponsive - and instead they'll withdraw cc services for future transactions - unless anyone has a better explanation? it also explains the cc management debates etc

I'm not an expert on these matters (so anyone who actually knows feel free to correct me) but this sounds like the CC company just trying to recoup some of their losses rather than a standard chargeback.

I would imagine that's exactly how it would play out, but it would be another adverse mark on their business record, and it only costs about 30 quid to do it. Think it's all online these days?

Cheers all.

Car has gone to WBAC on Friday afternoon and its replacement, a Passat estate has been bought already.

Just waiting for the credit card company to action their part of the refund and it will all be over.

Some interesting reading to be had on the report. It seems like the credit card company did have communications with the garage after all………

The credit card company upheld my claim and asked me to sell the car to we buy any car, which I did and then they (credit card) made me an offer to cover the rest, including the independant report.

Nothing extra for all the messing around but then I haven't had to pay anything for usage that I had. The Credit Card have arranged a BACs transfer for their part which takes up to 7 working days.

So.... money received from CC company so all paid up now.

On the report it lists a number of things that were found on the independent report and the car supermarket remarks against them. I found this a bot strange as the lady from the credit card company told e that they had no reply or communication at all from the supplying dealer. I then phoned up the garage that did the independent report and they informed me that they had been on the phone for about an hour with a lady from the CC company who was basically trying to get them to trip up or admit the car wasnt as bad as they had said.

Here are some of the comments on the report:

The independent report company have confirmed that in their opinion you should return the vehicle back to the merchant as there are too many issues with the vehicle.

Merchant said the vehicles suspension was damaged as you drove down bumpy roads not normal roads, independent report company advised this was not a possibility in such a short period of time.

Merchant advised that you could get repairs carried out under warranty, however you are entitled to have a car fit for purpose without having to have repairs carried out, the independent company again advised that in their opinion the car was sold unfit for purpose.

Merchant advised the diagnostic codes showing were likely due to codes not being cleared, the independent company advised the codes should have been cleared before the car was sold.

The headlight was levelled but the level motor was not replaced, as it should have been, the turbo was confirmed to having been replaced.

The independent company advised the PCV, and solenoid needs to be replaced, merchant did not know what the PCV part was.

It was quite cheeky of them to try and blame me for the issues with the suspension saying it was down bumpy roads and not normal roads?? how do they even jump to that conclusion.

Anyway, sorry saga done with.
