We will be in touch
In august I was away on 3 weeks holiday, all my tools and equipment were locked in their sortage cupboards and the keys left with one of the managers. Now when I got back 2 work stands had gone walkies, a total of £650 worth, Heres the thing my new CEO is trying to bill me for the loss, despite not being in the country and the equipment being locked away where they belong!!
Thoughts please more so from the legal eagles amongst the collective
In a union?
union? in the bike industry sadly not 🙁
If they were stowed in the place provided for you by your employers and the keys left with your superior, then I fail to see how you can be held responsible.
Or do they not believe that you had put them there? Do you have proof?
do they have proof you did not?
Would the y beasy for you to walk away with?
The fact that they are no longer there in no way means that you did it
Check your contract it is most unlikely they can deduct from your wages for loss of their equipment unless your contract specifies this and HOW.
I suspect they need to prove negligence as well.
The only one at ours is when you leave a laptop on display in your car if it is in the boot you are still covered.
they are 2 professional workstands for bike mainentance - I am an instructor, so they are not the easiest things to slip into your bag for a quick get away.
When you say your tools - are they yours as in you bought and paid for them or are they yours as in you use them when there? If they are your (bought and paid for) then you should be billing them for your loos. If they were bought and paid for by the company then assuming all was left where it should have been and the keys with an appropriate manager then you should be trouble-free - have you asked the manager who had the keys to confirm they were handed to them? If so, it would suggest the keys have then gone walkies...
mine as in the companies ie they bought and paid for them, from what I can work out at least 3 different managers had access to them when I was away.
Your employer ahs a duty to behave reasonably.
Are they insinuating they were missing before you left on holiday? What proof do they have?
dont seem bothered about proof or facts, just that I should pay?
Have you spoken to the manager that you gave the keys to?? Maybe he can shed some light on where they have gone. Or at least back you up in telling the CEO that they were there before you left. Or did no-one check?
They sound like a right shower. I would refuse to pay until they can prove you are responsible.
And look for a new job where you are treated as a human, not a piece of shit they can treat as they wish.
Name and shame.
I would also refuse to pay.
And start talking to the CAB in case things get sticky. Also start documenting conversations, events etc. It may seem OTT but you may well be glad you did.
