[Closed] Opinions? Bought a set of wheels which were faulty and not ridden.

So here it si bought some Mavic Crosslines from a very big tinternet based company, put the tyres and discs on and then mounted them in the frame and found that the rear was defectively assembled ie hub body mis aligned on the axle by a good couple of mm. They were never pedalled and taken apart and sent back as a set with a view to a refund or specific handbuild pro 2 wheelset instead.
Recived email today that they have been sent back to Mavic for warranty and may take up to 21 days despite the fact that once bitten twice shy I dont want them.
Can I demand a refund as they were defective or do I have to have the warranty repaired wheels despite the fact that I never rode the damn things?

If they're unsuitable for their intended purpose you are entitled to return them for a refund. I had a similar issue with a fork I purchased from a large online seller and took advice from Consumer Direct. Give them a call and find out exactly where you stand: 08454 04 05 06

How long have you had them, look into the distance selling act, I believe you have 7 days to confirm return of goods and have a full refund.

Cheers for that I did use that wording in my return email to said retailer. If I get no joy I will take it further, the company do say that wheel and one or two other items are not eligible on returns but the fact is that the only way that you find out an axle/hub is misaligned is through purring tyres/discs etc and dropping them in the frame.
Moral of the story is stick to Hope Pro 2 builds......

How long between receiving and returning the wheels? I imagine that they're going to Mavic to determine if it's a manufacturing fault or not. Either way providing they were returned promptly you should be ok for a refund. If you don't want to wait, you'll be better off asking for a replacement (being your pro2 wheels) rather than refund. Company will be happier doing this as they keep your money...

Mmmm, 7 days I know it took me a couple of days to get round to putting them on the bike and then took them off the next day and posted them back on the day after the Bank Holiday Monday. Despite posting them back first class insured (cost £24!) actually sent an email to see if they had recieved them as I had heard nothing-plane delays quoted as their reason for delay.

Faulty goods
The consumer is protected under the regulations within the cooling off period. Once the period has expired, the Sale of Goods Act 1979 then protects the consumer. Under the Sale of Goods Act 1979, the goods must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).

Goods are of satisfactory quality if they reach the standard that a reasonable person would regard as satisfactory, taking into account the price and any description.

Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.

If the goods are faulty, the consumer can ask either for a refund, or for the goods to be repaired or replaced at no cost to them, or for compensation

Yep, still up to Mavic to determine if the goods are faulty tho. Be friendly and see if they'll replace your wheels beforehand.

The company that sold me the wheels has today got back to me and given me a full refund which is good enough for me at this time and certainly better than waiting for 21 days for Mavic. It means that I will still be spending my money with them in the future (just not on Mavic wheelsets). 😉
