Getting a new frame sent under warranty from Canada next month.

If they mark it up as warranty do I avoid the duty but still have to pay the VAT and if so VAT on retail value of frame?

did the old one go back?

In theory it should be duty free but it can be difficult to get the duty police to play ball sometimes
You can appeal though if they get it wrong

If it's a replacement you should have nothing to pay.

No, I still have the old one here but it is a replacement, it was too broken to be worth sending back to Canada just to be binned there.

Have you still got the invoice for the original frame showing the VAT and Duty was paid? If so you shouldn't have any problems.
If you do get an invoice from the shipper for duty and VAT just explain that it is a warranty replacement and send them a copy of the original invoice and any docs that prove it is a warranty item.
I had something similar with a video camera and a copy of the original invoice sorted it.

I was living in canada when I bought the frame so paid Canadian GST and PST on it at the time which the invoice I have does show. Bought it with me to the UK 3 years later and didnt declare as obviously second hand.

That duty calculator says about a tenner for a frame worth £40!!

It suggests I wil have to pay import duty@4.7% & VAT as if it were a new frame

There should normally be no duty or Vat on warranty replacements as they have already been paid on the original item. In your case you didn't pay it originally.

You might get away with it but the item will need to be clearly marked on the commercial invoices as a warranty replacement item. Something like -
"WARRANTY REPAIR AT NO CHARGE TO CUSTOMER. A COMMERCIAL INVOICE VALUE OF $___ GIVEN FOR CUSTOMS PURPOSES ONLY"

I had to pay duty on a warranty replacement frame.
I just sent them copys of the original paperwork and emails between myself and the framebuilder agreing to replace the frame and they refunded me.

Not that it helps with your quesion but might if anyone searches the subject later.

What about the VAT though, did they let you off that too.

Yes as it had already been paid on the original import.
