My Wife has had a hip problem from birth that now needs surgery to try and alleviate the constant pain she is in, even with taking 8 Tramadol, 8 Paracetamol, 2 Motifene and an Amitrypaline a day.

She struggles to walk with a stick, and is having a triple P.A.O operation tomorrow, which will make her unable to weight-bear for at least 4 months, all of which she told the 'doctor' about.

Well, somehow he has come to the conclusion that she can walk, bend and kneel without any difficulty and should be actively seeking work. Despite the fact 2 specialist doctors have said surgery is the only option, apparently they hand these out for fun these days.

Anyway, I have been given an address to complain to, as he just seems unaccountable at the moment, but it is just the manager of the company he works for, which will unlikely amount to anything. How anyone can come to such a conclusion is totally beyond me?!

Who would be best to complain to, as it would be good to let the people know who contract the work out that the people they employ are useless?

Or is it the usual case that no-one will care and to get on with it?

😐 😡 😕

congratulations! your wife is now officially a cheating work shy scrounger who claimed sickness benefit and has been found to have nothing worng with her

as i'm sure you've found out by now, these medical exams are performed on behlaf of the state by a private company- atos origin. the theory is that they are accountable and that they are fair, adequate independent assessments but the reality is far from that. you can complain if you want, but no one is gonna care. it may have been a nurse rather than a doctor who did the examination. anyway, it's someone who can't get a normal job in the health service which should make you wonder at least a wee bit

the way forward is to appeal the decision to end her esa, if she hasn't done so already. you may need some medical evidence from gp/consultant to back the case.

i suggest going to a cab or other advice agency (councils often run them as well) and getting advice on the appeal

i think my email shows up in my profile if you'd like any quick info from me - i give benefit advice for a living...

Thanks winstonsmith, my exact thoughts on complaining when told to write to the 'Customer Relation Manager' of the company he works for.

Ideally I want to write to the people who gave them the contract, but the woman on the phone said it's a running joke with the staff that some of these centre's are known to disallow everybody, not that it's funny to the people on the receiving end of it, so they know there is a problem.

It seems ridiculous that they ignore the examinations from top specialists in this field, over the word of someone who asked a few questions for 15 minutes and just asked her to bend at the knees, which she did a little, with pain.

These idiots shouldn't be allowed to basically call you a liar and not be accountable.

Anyway, I'm ranting, heh.

We would like nothing more than her health to return and both be back in work, I genuinely wish bad health on these people, let them see how it feels.

while i sympathise with your situation and it seems quite clear that your wife needs incapacity support, the problem i see in everyday practice is that for every one patient who needs incapacity benefit there are many more milking the system who feel incapacity support is their birthright.
I would hate to to do incapacity medicals, I imagine it would make you cynical and twisted.
