Mate of mine was over paid by a weeks wages when he went on the long term sick. He is on SSP and without contacting him they have taken the money out of his SSP. Can they do this without consulting him.?

Employer. They overpaid the man and have taken it back out of his ssp without consulting him. I was sure they have to contact him before making any sort of deductions.
Why would they have to consult him? They overpaid him and then deducted that amount from his next pay. Fairly standard practice in my experience, just unfortunate.

Because he is on £85 a week on SSP and it has left him on his ass. I always thought that any deductions made my the employer except for the usual tax an NI had to be agreed by employee first unless something is written in to his contract.
Surely though, if he knew he was going to be on £85 a week, being overpaid a weeks wages and blowing it is his lookout, however unfortunate the situation is?

He should have kept it to one side, companies dont pay out extra on a

To be fair the man nearly died due to diabetes and was in position look after his accounts. Tough croud. 🙄

Not saying he doesn't deserve any help, but I know if I were facing the same lookout, I'd be on top of all expenditure (or whoever is my next of kin is)...

Oh I dunno, you get all sorts of stuff like tax back etc. it's not straight forward to understand sometimes, especially if you have other priorities.

did they overpay then deduct from the next wage or was it a few months down the line? I'd have expected next wage/ssp or maybe the one after that but if it's been ages then that's a bit harsh (but probably still legit 🙁 )
SSP is treated as any other type of salary and paid by employer directly who may be able to then get some back from HMRC; it doesn't attract any special rules regarding deductions.
It's probably the deduction from wages without warning which is the issue, which while I have no expertise in that area, would probably be policy of the employer (or lack of).
