Train was 1.5 hrs late due to a person being killed on the line - I ended up going over the parking limit and have received a fine of £80.
I've gone through the first round of appeals and been rejected. At the time of the appeal I couldn't provide evidence that the train was late but since then I've had s refund from Virgin so could submit this as evidence in the next appeal (to POPLA).
I could pay £50 now or £80 if next appeal fails.
Don't want to pay anything, of course!
Anyone had experience of appealing in the same grounds? Worth it?
Oh and I should add that I park in the same car park once a week, usually overnight, and have handed 000's to the owners of the sambed place over the last few years....grrrrr...they charge £22 for my average stay.....

Is it a station car park? If not why should they care why you over stayed? If it is then I reckon its worth a go

It's separate companies so appealing to the one issuing the fines better nature won't work - you need to find an actual grounds for the appeal against their own rules for the parking area.
It's a bit harsh but if you'd missed the train due to a bus being delayed by an RTA would you expect the fine to be revoked? If not why should the train being delayed matter to the co issuing the fine?

Anyway - yes, definitely contest it. Don't give the thieving gits any more money than you have to. You have proof that the delay wasn't your fault and I'd play heavily on them profiting from someone's loss of life which is pretty shocking.
Depending on whether its a privately run company, you could also just not pay it. There are websites dedicated to getting off paying fines from private companies, I'm sure there's some hand wringers on here who will play holier than thou but these parking companies really are the lowest of the low and I have no issue screwing them over. You'll likely get a letter threatening a court summons if you don't pay it, which will be sent from the same address but a different company name acting as their legal representative. Continue to ignore it and eventually they'll go away. This of course is only relevant if its a private company and not the local council.

OP, when you say you "couldn't provide evidence that the train was late", did the company ask for this as part of the original appeal? If they did then, that sounds to me like an implication that they would accept the train you were traveling on being late, if backed by evidence, as sufficient to waive the contractual overstay fee they have charged you.

To answer some of the other points:
1. It's next to the station, but not the station car park (private owner)
2. The Virgin refund doesn't cover the cost of the fine - and is to compensate me for other losses, not a parking fine
3.I totally agree that the parking companies are thieving bast4rds - recently got a £80 fine in one due to the fact that I'd stood at the machine for a few mins trying to get it to work, only to drive out and park in another car park because it wouldn't accept my change - you only got 4 mins to do this and I took 5!!! I managed to successfully appeal that one as I could show that I parked somewhere else immediately after.....grrrrr

We did this and followed all the advice at the time (6 years ago) to just ignore it. Fast forward to september and have just paid out £257 to the parking company to avoid a CCJ.

Totally justified to appeal. How can they have the cheek to refuse.
Realtime trains is only 7 days. The rail industry has the full data just it's not exposed to the public. It's how they verify your compensation claims.

Don’t listen to the “if you’ve done the crime to the time” or any other rubbish.
If you want to put a proper appeal together it will be some work, up to and including possibly sorting out a defence for court.

Well the only reason i opened a thread about late trains and parking fines was the [b]need[/b] to open a thread and it happened to be near the top. It's not exactly riveting subject matter you see but there seems to be a lack of exciting threads this morning.
But I'm not addicted, oh no, it's just an effective and necessary way of distracting my self from the drudgery of the work day.

private parking generally relies on (civil) contract law. A change was made some years ago under the protection of freedoms act to allow Private parking companies to be able to hold the keeper of the vehicle liable where before it was just the driver as the driver was the only one who could form a contract.
Bylaws apply to some land, airports and railways specifically where old laws haven't been updated. Parking enforcement was outsourced to private companies who don't really have the right to enforce bylaws (only the landowner can) yet they rely on the bylaw to charge you. Its a bit naughty..
The protection of freedoms act dosnt apply to bylaws so in theory the PPC can't chase the keeper only the driver so at the point of the ticket you just don't tel them who was driving (you are under no obligation to tell them) Quite often the tickets are basically incorrect so there's another appeal point (you cant rely on contract and bylaw)
Appealing as the driver has closed the first point here.
If this was a first appeal to the PPC and its now going to POPLA then there is a chance the appeal will be upheld but the OP will need to pot evidence together, not just my train was late...

I sat on a (delayed overcrowded) train this morning plotting a way to visit every NCP ticket machine in the area during the early hours of the morning. Using an electrical device I'd disable it thus costing a small fortune to fix each machine. I'd probably dress all in black, probably with a mask or some sort and flick the security camera the bird as I strolled off into the darkness like a total badass leaving a wake of carnage behind me.
Then I realise
a) I have no knowledge of electrical devices
b) Once I'm off the train and calmed down I probably won't be arsed and breaking the law scares me
c) I work in IT and have the upper body strength of an 8 year old
d) I need to stop reading assassin books
e) I have anger management issues

Working in IT, you need a BOFH clamp. Leave your phone at home and give the machine a good shocking. A small EMP will also do the job. Fried circuit boards and runaway silicon should cost a small fortune to repair.
Failing that petrol bombs and burn them like the speed camera on the A14 at junction 35. (I've not given this much thought, not at all). 🙂
