[Closed] Now that's a bit harsh...new employment contract

In my new contract I see that if I'm sick straight after a holiday then any days taken of ill are taken as holiday days; anyone else have that? Or other unfortunate terms?

We monitor for patterns one of them is sickness before and after hols.

Simple , tell them you were sick before the holiday ended that way you may be able to claim some holiday days back?

I would hazard a guess that this is an unfair contract.

Go into work and then go off sick, youre not on holiday if youre back at work are you.

Strangely most sickness occurs on a Friday and a Monday.

I worked with a guy who afer a fornights leave claimed that he was sick for three of the days and got back three days holiday.

I'm sure it is a fair contract as my new company is rather large and must take advice on these things - I see that if we get a doctor's note then that's fine.

No mention of claiming holiday back if ill when on holiday - does anyone have that?

Yup we do if you take ill you can get it back, I never do unless it's an injury or hospital job.

Yes ๐Ÿ˜€ self-cert up to 5 days, sicknote for longer - if we have sick days that straddle w/e those 2 days count towards the total sick days, not sure about sick after holiday......

Our place lets you reclaim holidays taken if you were sick beforehand & it continued into the annual leave days.

On the plus side if you're sick after a holiday its just counted as sickness. That seems to happen to me fairly often thinking about it ...

Hmmm, actaully it's not quite most, but my friend's boss's recruitment consultant's orthodontist did say that an astonishing FORTY PERCENT of sick days occur on Mondays and Fridays.

how can that be legal !? they can decide not to pay you for being sick but they can not just take it from your holiday entitlement.

This is what we do, but we obviously monitor sickness pre/post holidays closely. Think I am about to test it tomorrow, been on leave since 18Dec but came down with Manflu over the new year.

40% Ay where as the other 3 days are 60% that's almost 20% per day on a working week. ๐Ÿ˜ฏ

In my last job, any days taken sick immediately before or after holiday days had to be accompanied by a doctor's note (normally only needed that after more than 5 days of sick)
