I broke mine once, and the replacement from Virgin was far better than the original.

Does that help?

I lost my HTC Touch 3G during a house move and had it replaced with a HTC Hero. I was quite happy with that...

If it's an old phone it would seem unlikely that you'd get something worse.

My replacement phone was reconditioned I think. Was never 100% as good as the one I lost.
