Right, job finished december, not particularly well i might add. I was unable to get final timesheet signed, have been told by agency that client won't pay.
Client is a **** and trying to avoid paying does not surprise me.
I am on dole so although not a huge amount of money i do actually need it.
Any advice about what my options are. I really don't want to go for
Have a read of your contract with the agency ? Does it say they won't pay unless time sheet signed ? If yes, then get timesheet signed. If they were unhappy enough with your work that they won't sign it, then your only option is to report for more training.
the person i was working for was a **** i knew he would kick off and refuse to pay, i hadn't planned on walking out, circumstances led to it. I'll have to see if i can find the contract.
Do you know his clients or even who they are?
yes, it was a sales job, and the customers said he was a **** when i started and a number refused to speak to him etc. He was no help when needed whinged when things didn't get done, but when you pointed out the reason it hadn't been done was because he had been asked to sort it he always found something else to do and forgot again.
Plus a general bully, obnoxious, stank of stale fags, drove a beemer, acted like gods gift, I also discovered he had a restraining order served re another employee, a number of warnings issued because of his behaviour to my predecessor.
Agencies can no longer withhold payment on a non signed timesheet, they are allowed a reasonable time to resolve the issue but they just can't say no time sheet no pay.
Kingtut, do you know where that is written down so i can use it against the agency.
Thanks.

They will probably use the defence that they have no other way of verifying your attendance, if you can prove you were there then they shouldn't argue, they can also verify your attendance with their client, if their client refuses then it's legal matter between the agency and their client.
Unfortunately this would delay payment to you.
thanks as i have spoken to the agency and they have emailed to say why they won't pay, attendance wasn't mentioned as the reason. I will have to see what i can do.

See sub section a, they can't use this as a reason to withhold payment.
They can withhold if you're a limited company, if you're paye they do have to pay you
