And soon enough there won't [b]be[/b] any new DS games to pirate, as all the developers will have gone out of business.

There's little enough money in DS game development as it is, publishers don't like the platform because of rampant piracy, and no one in their right mind would base a business model on DS development these days.

There is a counter argument that games are too expensive, and would I agree with that - the cut taken by retailers, distributors and publishers is huge. Still not a good reason to take something without paying though.
