Credit card charge back - Company coming at me for a debt now..

legally where does this stand. 

 

Long story short i ordered some stuff - half of it never arrived. 

i supplied lots of evidence - they doubled down on them having proof of it arriving. 

I have CCTV evidence of the number of boxes that arrived , I have photos of them when opened , the invoice has a weight of 15kg . the shipping invoice from the shipper has a weight of 9kg. and more so the volumetric area within the boxes they sent could not physically have contained the items they said they sent in the two boxes. 

The items I'm missing from the boxes that are on the invoice add up to 6kg. 

when they started their nonsense i went to visa and issued a credit card dispute - they refunded me immediately and after 2 months sent me an email stating its been found in my favour. 

today 3 months later out the blue they have come at me saying i have a debt = to that of the refund. 

 

 

they have been told to foxtrot oscar and go speak to visa and not to contact me again on the matter. 

how's this going to play out you reckon ? I've got plenty of evidence I'm more than happy i can prove i never received the goods.

Visa is just the payment facilitator, they are quick to grant chargebacks as it's not their money it's the merchants they are giving back. There's nothing to stop the merchant chasing debt directly with a customer, that doesn't mean it has merit and there's a few steps before it would become legally enforceable. 

OP is the debt at least in the hundreds?  Then it might be worth their while to take to small claims where you will have to present your evidence, if it gets that far. I take it you have the money and half the goods? I think realistically they are entitled to reclaim what was delivered or be paid part of the cash. I would have been simpler if nothing had arrived. I wouldn't sweat if for now but if this is the case maybe tell them 1. what evidence you have 2. they can collect what they did deliver and you'll consider that the end of it.

It's possible debt has been sold to a collector who once they realise they might not have a case will drop it anyway.

It's 200 quid 

I have written confirmation from the bank that visa have ruled in my favour with the evidence presented. 

 

I'm not overly concerned but it's just cemented their place in my do not use do not recommend list

Similar but not the same - I had someone buy a house from me and then 3 months later when the upstairs loo leaked come after me for costs via solicitor but direct to my new home address (which solicitor had..).

A strong Foxtrot Oscar letter with 'caveat emptor' from me was ignored.

They kept sending increasingly strong letters. 

Eventually I replied with a 'message me again and I start legal action for Harrassment.

It stopped.

Oh and for the record further to foomans post  I've paid for the portion of  goods received it's only the undelivered goods I sought refund for I'm not a total dick 🙂

Drop a message to your credit card company notifying them of the situation with the evidence. Retailer may find their ability to take any credit card payments are mysteriously restricted.

Fastest response I've ever had out of them. 

My file has been passed to the debt recovery department and should I change my mind about paying I should let them know. 

Autodoc fyi. Liars and bullys. 

Forwarded on the latest email to my case handler at nationwide.

Interesting (to me anyway) that's it's autodoc. I was searching for something the other day and they came up in the web results. Looked too good to be true on the prices so I went elsewhere.
This is of course no help to you 🙂

Don't get me wrong I've used them for years without issue but it appears when it goes wrong they make it spectacular 

 

Won't be using them again

Not very worried. 

It'll get resolved in time. 

No plans to move house. 

It'll cost them a lot more than. 200 quid at this point I'll burn it before I give it to them. 

Long and short is that they cannot prove they delivered the kit they claim to have or they would have contested the visa claim successfully.

There is no debt: the OP paid in full. He was refunded by his credit card company, not Autodoc. There’s an issue with harassment from a third party debt agency, but even then the agency should be chasing the bank and not the OP.

You're not taking on Autodoc.  Autodoc no longer care, they've sold the alleged debt.  You're taking on a debt recovery agency, which is why I asked the question in the first place.

I've misread your post - they passed it on to their internal debt recovery department (office next door) - crack on and argue then! 😀

It's only when they pass it to external ones who don't give a shit about the rules that things get dirty and nasty.

i passed it to my case handler this morning. 

I'm not even responding to Autodoc. - to be clear it is autodoc i was dealing with - they are NOW sending it to someone else.

Oh and to top it off - I've just found an email from another operative that I was sure I had but couldn't find yesterday where autodoc admitted they had ****ed up at the warehouse. 

Magic.

There's no credit agreement in place, so no effect on rating unless they go to County Court. The fear of a CCJ is bad, but the reality is, you can hold off until the morning of the hearing to make a deal, but given the evidence it'll be thrown out.

Debt collection agencies are powerless, they will send aggressive letters and make intimidating phone calls but they arent personal. They are just great bulig threat machines with no teeth. They cant send in the baliffs until they win in court and no one does that to recover a £200 debt.

They may eventually issue a letter before claim and even initialise court proceedings which most of the time they drop when they have to pay the court fee. £200 is small claims territory (or whatever its called now), they are capped as to what they can claim. At a guess worse case is your £200 turns into a £400 CCJ which still wont affect your credit rating if you pay it in time. Given your case, evidence and the disputed amount its very unlikely to reach court and even if it did your chances of winning are high based on what you've posted.

Thing is - they already have all my evidence - they just refuse to acknowledge it. They also have not yet responded to my requests for my multiple requests for evidence to the contrary 

my last email told them to stop contacting me over it. 

I'm no longer engaging with autodoc - at least not until visa come back to me. 

 

At which point it will be a gemini generated formal dispute template

id be emailing a couple newspapers and posting on reddit too. Be sure to hit up AutoDocs trustpilot also. They are being incredibly daft by torching their rep for 200 quid.

This is a pissboiler imo as someone anxious would give in to their bullying.

I'd do nothing at this point until you get the collection letter.

Then hopefully I can tell you how to tell them to go and **** themselves as well.

I've seen this particular movie before.
