I was asked this question by an American friend and i really don't know the answer.
I'd say no, she'd be fine. And I'd be surprised if she is convicted in america. Driver is responsible for saying no.
seems fair to me. just like joint enterprise - you don't have to be the one who pulled the trigger/held the knife in order to be culpable.

I doubt they would be charged for murder but i suspect they would be charged with something

Being charged is different to being convicted . Here I assume you could be charged with manslaughter but i'd be surprised if it resulted in a conviction . I had a client charged with aid and abet causing death by dangerous driving . He was the passenger allegedly giving his wife a driving lesson that went horribly and tragically wrong . I could not see how he would be convicted and indeed the cps dropped the case .
