I have a company (lease) car. Back at the end of Feb, someone kindly took the side off it overnight and it was in the garage for three months being repaired.

For tax purposes, do I declare the shitbox courtesy car as a change of vehicle, thereby reducing my tax for three months, or does the actual assigned car still count even though I've not had use of it?

Good question - all depends what the company declare on your P11D IIRC.

My wife had similar and didn't check her P11D and was charged tax on two cars (the written off one and the new one) for the best part of a year as that is what they declared she had.

Company wouldn't re-submit a corrected P11D, but after a lot of wrangling, did re-imburse her for the extra car tax....

It may be worth asking the question as there will no doubt be a big difference in BIK for that period.

I personally wouldn't rock the apple cart though as i've never had anything but issues when it comes to company cars and HMRC.

Well, I've just got my P11D through which doesn't even mention the current car, which is what prompted the question.

Your P11D should state the number of days that the specific car was available - if it's off the road then imo it's not available. Whenever I've had hire cars in the past, that has been reflected on my P11D - I don't see why a courtesy car should be different. That's only my opinion though ๐Ÿ˜†

Based on my experience 4 years ago;

You 'should' be able to claim for the time you had the lower value/tax vehicle

However, if your P11D states that you had the same car for the 12 months in question you are going to struggle to get that sorted with HMRC

You would need your company to correct the P11D, which they are unlikely to do.....

Yeah, it was a mess. First repairer sat on it for a month before going "we can't do this" and sending it somewhere else. Final cost was six grand plus VAT.

I take it that you haven't had to pay any of your own money towards to the courtesy car? That being the case logic would imply that you are still receiving the benefit of a company car and are therefore liable for the additional tax that comes with it.

Based on my experience I agree that they may well read the P11D. I've just had an extra tax bill from the year ending 2014 after a mistake I made on my return for that year.

I have always contacted HMRC myself when I have changed company car (relying on the company to do it never seemed like a good move) and never had any problems. Meant I had always paid the correct tax on the correct car.

I presume your company were still paying the lease on it while it was being repaired? If so, I think the tax stands as it is based on value and emissions and these remain the same.
