Morning all after some advice !

Driving to work this morning pulled out to go left decided not to go and the van driver behind me drove into the back of me.

We pulled over to a safe spot got out back of my car mullered his van fine...

Polite chat etc he was really apologetic said did I want to go through insurance I said if you pay me the value of car 2000 w reg micra with 30000 on the clock so about £700 id be happy, hes happy to do this but should I go through insurance ?

Im not hurt, a little shaken

Bit peed off re the car as its been a great London commute car, used daily to get to work over 6 years never used on the motorway etc

What should I do ask for ££££ or go insurance which will be of no benefit to me as policy will go up and they wont give me the value of it.

if he's happy to pay the cash, and you get it in cash then go for it, I wouldn't go insurance for the increased premiums.

If he's willing to put you back on the road in the same vehicle make and model, surely that's the best way to go? Presumably he won't mind stumping up for any extra travel costs as you sort out a new car?

What cp said. If you go through insurance your premiums will go up. If you are happy with that value then go for it. I'd double check the value and make sure you can get a replacement. It'll be much quicker, too. You can be car shopping today.

I have no advice for your insurance claim but you should be aware that driving on motorways is GOOD for cars, and driving around town is worse 🙂

Do you trust him to pay you? He could claim he wasn't there, Did you get any witnesses?

You are supposed to tell your insurers that you've had an accident whether you claim or not...

You're not hurt, take the money, don't involve the insurers.

If he doesn't pay, say in 10 days, contact your insurers.

My previous insurer had to be told within 48 hours of the accident or something like that...I'd be talking to my insurer if only to advise.

Whats said at the scene of the accident is so easily reneged on after and before you know it, it was your fault and there's a whiplash claim...just happened to my parents 👿

Take his money. Ask him when he is going to pay out. If the car is a mess, then weigh it in and get some more. if its repairable, then spend a few quid straightening it out and use it again if it shows to being reliable. Make sure you see the colour of his money first and quickly before having to speak to your insurance company if he doesnt pay out. Van insurance is very expensive as a trader, so he may well be happy to give you cash.

I once advised my insurance company that my car had been stolen - despite making it clear that I had no interest in making a claim (cheap car, high excess, just not worth it), they increased my premiums anyway. Thanks very much - I've just demonstrated to you that I won't make a claim even when I'm entitled to and that makes me more of a risk. I would never inform them now, unless I was certain I was going to make a claim or if I was at fault.

I have a company vehicle. It is now company policy that if I'm in an accident I give the other party a pre printed peice of paper which says "don't go through your insurance, we will pay everything... but whatever you do don't go though your insurance" with all the details of who to call etc.

Something similar happened to me years ago when I was 17. Blokes says I'll give you cash, went around to his place the next day to pick it up. Turned around and said f you. I ain't paying. He was a proper meat head, even my dad who was a bit tasty when it came to a scrap decided on this occasion it just wasn't worth it.

Moral of the story, people are always full of good intentions in the heat of the moment when the adrenalin is pumping and it's just happened. After they have cooled down and actually consider how much it will cost them, most will try and get out of it.

If he/she comes up with the cash today/tomorrow, okay, if not, report.

Common sense says wait to see if you have any injuries develop in tbe next few days*, and if not, take his money and it is done and dusted.

However, when you next take out insurance they will ask you if you have had any accidents. If you say "no" and by some twist of fate they find that you lied on your proposal, that may invalidate your insurance. Which will be a balls ache if you have just driven into a bus queue of gifted neuro surgeons who have now lost the use of their hands.

Unlikely, I know, but a theoretical risk.

*even as a cynical former claims handler, whiplash symptoms can take time to appear

Does it though?

I had the exact same accident as the OP where I was rear ended but the other person admitted liability. My car was written off and their insurance paid out & I got a replacement vehicle, which incidentally was a lower insurance group some my premium actually went down.

However, I did ask my insurance co whether my premium would go up in spite of and they seemed to suggest it wouldn't.

Or is this only applicable if the other party claims full liability?

Premiums go up year on year anyway TBH, who's ever not got the renewal and found it was 10-15% higher than last year!

Not looked for a while, so I could be wrong, but if the car's in good nick I reckon it might be worth more than £700. I was looking for one about that price (older ones too, so relatively about the same) a couple of years back and gave up in the end. All the good examples were going for double that.

Also I think accidents have to be reported within 24 hours, otherwise that might cause you problems. Had a couple of non-fault claims myself and both times settled with the insurance company of the offending party. Not noticed any rises with my own insurance, though I'm sure they're probably there. I guess they wouldn't actually tell you. I've never at any time needed to speak to them though.

I was worried about that, but it made no difference to my premium, after some on went in to the back of my last year and wrote my car off.

had this with the GFs car. He thought it was worth £150-200 though.

It was closer to £700 so had to go via insurance.

He may well have been driving without insurance - you might want to consider that.

It won't do you any good, but it should probably be reported in case he gets involved in a bigger accident and really does someone a mischief(?)

He was insured as checked online this morning.

We have agreed £750 to settle out of insurance.

Still annoyed !
