I'm in the process of letting a property for the first time in years. They want a 12 month tenancy agreement (i only really want 6 and i asked for it but they said no)
Am i right in thinking that on the 1st of May this rolls over automatically into a periodic tenancy anyway, because of the new laws - and i can give 2 months notice at any point?
Or is there somthing that they can write into the tenancy agreement that prevents this?
Seems odd they are trying to force me in to a 12 monther in the light of this (big national estate/lettings agency)

Edit: they've not sent through the agreement yet so can't see if its a standard AST
The agent wants a longer contract as that's what they ll bill you on in commission. Even on tenant find, my agent said tenant wanted 3 years, so x% x 36 months X rent was lots of fee income, up front too.
In the new regime tenant can serve notice at any time irrespective of contract duration.

Its me that looking to rent.
The Agent/Landlord wants a 12 month contract.
I'm wondeing why, when in 6 weeks it reverts to a APT automatically. I poentially want to leave after 6 months *if* i've found somewhere to buy.
With the new legislation i should be able to give 2 months notice at any point i think.
Is it a mistake to sign a 12 month contract now - is there anything that could prevent it going to the new AST?

I was confused but see you have clarified, you are renting, the landlord/agency is letting the property 🙂
Sorry I don’t know the answer unless it’s as suggested above, the agent is trying to do the owner over for a years commission up front

they sent through a draft contract which has this at the bottom buried under 12 pages of appendicies.

advance written notice must be served on the other party and the tenancy must not expire within the first 10 months of the Tenancy commencement date.
