You need to find a GOOD seller..

I sold a roadie last week. Bloke recieved it and it's damaged in transit. Even before he'd emailed me pics, i'd given him a full refucnd, so am currently out of pocket while i claim it back from the courier.

When you buy goods from a private individual, you don't have the same rights as when buying from a trader. The legal principle of caveat emptor or "buyer beware" operates. You have no rights to expect goods to be of a satisfactory quality or fit for their purpose, [b]so you should check goods thoroughly before you buy them[/b]. However, the law does say that even private sellers shouldn't misrepresent goods to you. So if something has been misdescribed, you might have a claim. Seek further advice if necessary.

Do we know if realman posts on other forums? It might be good to post this link on other forums, save him doing the same again to another unlucky buyer. I used to enjoy rm's posts, but shame he appears to be a scumbag. I hope he does the decent thing for the sellers sake.

Perhaps people are hoping that keeping the thread in sight with most people hoping rm does the right thing, might just help nudge him in the right direction to sort the buyer out. Or we could just accept that ripping folk off is fine on the classifieds.

The buyer has a claim insofar as the seller has misrepresented the goods. The description is vague but imo def states the brakes were in better nick than they actually are. The buyer's loss is prob the difference in value.

But how feasible is this, in 'real life'?

I imagine ittud be really quite difficult to sort things out in situations like this, as it often comes down to one person's onion over another.

I once sold a medical centriguge on Ebay, stating that it 'needed repair'. Was as honest as possible, wazunt trying to rip anyone off, wooduv bin happy with a fiver tbh.

Bloke who bought it also bought the fully working one I was also selling, then comes back with negative feedback cos he felt it were 'item not as described'. It wooduv bin impossible to be any more honest about the thing really.

I offered him a full refund, apologised that it wazunt what he wanted, etc, but he preferred being an arsey knob instead, and left the only bit of negative feedback I've ever had. Which was unfair and it's not possible for me to remove.

So, if things come down to mere onions, who arbitrates proceedings in such cases?

I think you're right - though ebay has (fallible) protection and also "reputation" scoring
On here we have reputation and probably more importantly, from regular forum users, some sort of emotional investment in "the community". Hence advice to only buy from regular forum users

They help enhance my ego though, it's 'attention', innit? 😀

I love the irony of people making statements about my ego, yet actually polishing it even further. 😆
