So there I was cycling home at 11:50PM on clear London evening, when some PSCO runs up behind me and grabs me, while I was stopped at some lights!!! Because I cycled a very short distance across a completely empty pavement.
The man clearly had some issues as he was very aggressive, just started shouting at me, give me ID, give me ID. Like a fool I gave him some, which was my drivers license.
He gave me a £30 FPN ticket, but I never signed anything and he miss-spelt my surname, and address. He got the street name right and postcode, but listed it as 12 My Road, London. When my address is not London.
Can I expect them to track me down?
Few years ago I got FPN on my motorbike, that was a proper ticket, which as officer wrote down, it went through onto a copy underneath which i kept. (standard ticket that splits in two copies)
This cycling one though is not like that its on thick paper? It really does not look like a proper ticket???
Have people contested these kinds of tickets before? Asked for photographic evidence?
Any comments welcome 🙂
Chap I know recently got off something similar simply because when he dug around a bit, it transpired that the C3PO who stopped him didn't actually have the delegated powers to do so.
I know parking fines get regularly overturned on spelling mistakes.
You allowed a chocolate Teapot to give you a FPN?? I would've just laughed and pedalled off.
some PSCO runs up behind me and grabs me,
Assault charge, then?
Thanks, how did he get 'off' it, did he take it a Police Station and contest it? Also how did he find out he did not have the powers? I think all Met Ones did? :/
My surname has fairly big spelling error, its nothing like what it should be and as i mentioned, my town and county is not on the ticket.
the C3PO who stopped him
Thanks, I've just choked on my lunch.
(-:
Teapot to give you a FPN??
I know! I should have had balls to just ignore him, or reject the ticket.
Assault charge, then?
Just grabbed my back pack, although he forced me to stay on the road, on the corner of Regents Street, so bendy buses where passing mm's from my feet 😮
First of all, was this footpath or footway? Footway runs parallel to the carriageway and forms part of the highway. Under the 1835 Highway Act, you my not driver a carriage (including bicycles) on the footway. Other pavement areas will be footpath. As such, it's a civil issue and even if the land owner is the local authority, they are the ones that would have to raise an objection to the trespass on their land. Even then, all they can do is ask you to leave by the most direct route and/or ask reasonable reimbursement for any damage caused. At least, that's how I understand it from our rights of way officer.
Hobby Bobby and Fake Bacon are two of my favourite terms....
Is your street really called My Road though? 😕
😛
Humm that I will need to check that on the ticket and read the small print, I don't remember exactly.
It was Picadilly Circus, this was section in question:
I am guessing that is classed as footway? Although its in front of all the shops, so could be footpath?
I was in wrong lane, I wanted to go up Regent Street, not be filtered round,so i decided to cut across pavement to crossing lights. (or maybe PCSO would like i stop in the middle of road!?)
I would not have done this on a Saturday afternoon, but it was 11:50PM on a Thursday evening!
Is your street really called My Road though?
No, i've been stupid enough to give out my real details, not doing it again 😛
So imagine the street you live down, it says that. But instead of putting on correct down he put just London
Honestly, tell them to get to f*ck.
The number of bloated, fat bastard coppers I see wheezing up and down the pavements round here...they need to get their one house in order first.
But really, as said above - any copper/PCSO that tries to fine you - just ride of laughing.
he didnt spell your name or address right - then YOU weren't given a ticket, someone with a name a bit like yours in london does 😆 seriously whats going to happen if you dont pay; the writ will not be served on you.
equally you are in the right as you gave him proper ID and ample opportunity to fill in the paper work,
**** em 😈
So to clarify he got your name wrong, and he got your address wrong, so in theory it's not you..
...and said in best Fast Show Voice "you ain't seen me right"
Cheers for the replys all!
Yes he did get my name wrong in the surname spelling and not put the full correct address. My main worry, is they will actually do some detective work 😯 as they have my real postcode they could track my full correct address down. Also out of interest what details he the PCSO keep? I don't remember seeing the whole ticket from his book, but from the tear off ticket what would he have kept?
I don't remember him writing the address twice ❓
But on the other side, they might look at all those details think its fake and ignore?
Also as mentioned, I gave him my drivers license (yes I know what a muppet!)
He had everything in full right there, but he still c*cked it up!
You must have a wonderful life to be generating any degree of 'worry' over this.
err - you rode over the pavement, which is a little naughty - not much but a little. The FPS is only £30 for goodness sake - just pay it??
Rachel
Different Chiefs and Commissioners give different powers to their PCSO's.
My advice to avoid any unecessary embarrassment in having a summons arrive unexpectedly or real police calling is swallow your pride and pay the fine but more importantly as you and others have pointed out, learn from your mistakes 😉
As for the clips 😛
