Ever since a long thread on counterfeit products was allowed on the forum as well, I'd imagine.

I'm guessing he's talking about the various Fakelys that have been bought from DX and the like

As long as the seller isnt trying to deceive and pass off as the real thing then I dont think it matters

Yep all the fakely threads and ads.

I'd say it's leaving stw open to prosecution and at very least is bound to piss off retailers who pay to advertise on here who are Oakly stockists (no personal interest here by the way, just know it's not allowed on most forums)

I tried to Ebay a "Specialized" jersey that I'd bought, er, remarkably cheap from China and I received an email from Specialized via Ebay asking me to remove it from sale.

Dunno about the legalities tbh, but it definitely lowers the tone.

Can we have a ban on people wearing Burberry scarves as well please?

No worse than folk recommending illegal downloads of software/maps etc - and that's been tolerated for years. 🙄

On a more important note...

Since when has the accpetable brand name for fake Oakleys been Fakely?

Shirely it should Foakley.

It has not. We've warned and banned many people for promoting illegal downloads and piracy.

The Classifieds rules and guidelines have been updated to include a rule about fake goods.

Cheers Mark. There's probably more slipping under the Mods radar than you are aware of.

I'll update my "Report Post" Macro to include that option.....

Just out of interest how will people selling genuine items be treated if someone decides for some reason to report them as fake?
I'm sure most of us can tell the fake v real Oakleys but possibly not always?

So I can no longer sell a Dx bastid light on the classifeds? (a rip off copy of a lupine light if ever there was one!!!) or my tubless ghetto converted wheelset 'cause I didn't use the proper genuine stans valves or tape?

How far are we taking this?

Can I sell a no name seatpost that's a blatant Syncros copy?

There's plenty Chinese carbon frames that are copies of Niners etc. What about those?

Superstar, Fibrax etc sell copies of everyone's brake pads.....

Do the fakelys have the O logos? If not, they are imitations rather than fake. Agree with the points above. I've bought a couple of golf clubs off ebay that were blatant counterfeits - no one here is trying to do that I assume?

Sounds like over reaction to me.

To the point of common sense I'd have thought.
If you describe your no name seatpost as a no name seat post that's a blatant Syncros copy, I think you'll be ok.
Same as selling a DX as a DX and not a Lupine, or Superstar as Superstar and Chinese copy as a Chinese copy.
Isn't the only problem when you come to passing off the fake as a genuine article?

I think that's what we are trying to determine. Is this not a question of trade mark and copyright? If I sell some sunglasses to you and they are clearly a direct copy - with logos etc - of some Oakleys, even if I tell you they are not genuine I am still trading in counterfeit goods. That is illegal and I might expect a visit from Trading Standards. Plainly, STW cannot be seen to support this activity.

I guess that if the manufacturer of the replica has acquired the rights to make it then you have the right to re-sell it. Otherwise it's fake/counterfeit?

no, because the thread is about fake goods advertised as such.

And Mark's update in the rules

NO FAKE GOODS - in almost all cases selling fake goods (even if you declare they are fake) is illegal.

is pretty explicit in including declared-fakes.

As mentioned above [I don't know these products], DX, Superstar, Fibrax and the Chinese framemakers would appear to be pretty knackered.
If only the real world was so simple.
What is going to be done about reproducing photographs without the photogs permission?
There's a thread which would appear to be breaching copyright law, unless people are buying photos with watermarks included.

The rule appears to be,

If it's illegal, it's against forum rules. If it isn't, it isn't. Seems fairly sensible and straight-forward to me.

Nope. DX lights are labelled as DX, Superstar components as Superstar etc so are not fakes. They may have copied someone elses technical design but they are not fakes ie. purporting to be something they aren't.

Now, given what Vinneyh just wrote, was that self censorship or was he modded like his FS thread?

Edit: Heh.

I have nothing constructive to add. 😆

I don't think Superstar are passing off their goods as being made by someone else or copying anyones design. It's mostly stuff pulled from a catalogue and branded on their behalf, same as it is by many other folk.

Impossible to police, fake stuff is a fact of life and STW is not the place for any kind of attempt to turn back that tide.

Be realistic.

How about that bloke wot copied Dekerf frames, had them made up in Far East from gas pipe, rather than handbuilt from Reynolds by a bald bloke, called them Inbred or something. What about him, well, what about him???? I think we should be told! 🙂

It may well be an offence to allow counterfeit goods to be traded via your website (as it is if you run a market/car boot sale).

Be realistic.

They are being realistic, if it appears to be fake you can't sell it and the thread will be pulled
Of course some will get through but I don't think they thought it was a perfect solution just a common sense one

It may well be, and probably should be.

However, the question of policing it arises, and I can't see how STW can possibly do that without someone sitting down and checking each and every classified ad for potential fake goods.

It's just not a realistic proposition, IMHO.

Maybe your reports inspired the new rule, some decision we don't not take straight away and involve discussion with the mag/forum owners.

It seems fair. A lot of the companies;eg Oakley, don't mess about. It is not so much a case of "stop allowing these ads" as "give us a lot of money for allowing them." Classifieds is after all,a privilege.

Chinarellos? There were a few copies of high end Italian branded carbon road frames doing the rounds a bit ago that were of questionable authenticity. Still carbon, but different layering to the real thang. Quality depends on your expectation.

Wondering what the ops motivation for posting was though. Been stung?
