[Closed] Ebay (again!), use Small Claims Court?

My wife ordered an "orthopaedic" mattress via ebay, which when delivered was folded in half and after having it for 48 hours unwrapped, still had a noticeable crease down the middle and was really soft and unsupportive anyway.

We conacted the seller back in February who keeps promising he will arrange a courier to collect it and have raised ebay grievance, but they are rubbish and to date no courier has turned up.

We have his full name and address as it was placed on label for courier?

I am tempted to charge £10 a day storage for it and cost of putting it in my van at 50p a mile and delivering it back, along with original cost and issuing Small Claims proceedings as seller is just ignoring us now. Reckon it is worth it?

As above. Just get a refund through eBay. Simple.

No refund as yet, ebay just state that seller has contacted them to say he is arranging courier, we have 3 dates so far and not turned up.

Too late for ebay refund I'd have thought, so small claims court it would be.

Distance selling regs cover you even if ebay do not
I assume you can prove you contacted them to decline the goods

There is a whole string of ebay messages, mostly from us, stating originally that we wanted a refund, then him promising the same, followed by us chasing and him promising a courier, the last date we were given was last tuesday and no-one showed up, so it can all be documented.

How did you pay? Are you past the 90day PayPal refund time period?

Why didn't you push the paypal/ebay routes sooner?

When you say you have raised a grievance do you mean you opened a dispute? Is it still open? If so you still have a good chance of getting your money back through eBay/PayPal.

Did you use a credit card?
They are very good at chasing these things and getting you a refund. Always use a cc for online purchases.
